Northern Ireland has entered what is arguably the key phase in its troubled political history - truth recovery and dealing with the legacy of the past - yet the void in knowledge and the lack of academic literature with regard to victims' rights is particularly striking. This book analyses truth recovery as a fundamental aspect of the transition from political violence to peace, democracy and stability in post-conflict Northern Ireland. "The possibility of being a victim of a crime is ever present on my mind; thinking about it as natural as breathing."--40-year-old woman This is a compelling analysis of how women in the United States perceive the threat of crime in their everyday lives and how that perception controls their behavior. Esther Madriz draws on focus groups and in-depth interviews to show the damage that fear can wreak on women of different ages and socioeconomic backgrounds. Although anxiety about crime affects virtually every woman, Madriz shows that race and class position play a role in a woman's sense of vulnerability. Fear of crime has resulted in public demand for stronger and more repressive policies throughout the country. As funds for social programs are cut, Madriz points out, those for more prisons and police are on the increase. She also illustrates how media images of victims--"good" victims aren't culpable, "bad" victims invite trouble--and a tough political stance toward criminals are linked to a general climate of economic uncertainty and conservatism. Madriz argues that fear itself is a strong element in keeping women in subservient and self-limiting social positions. "Policing" themselves, they construct a restricted world that leads to positions of even greater subordination: Being a woman means being vulnerable. Considering the enormous attention given to crime today, including victims' rights and use of public funds, Madriz's informative study is especially timely.

Nationally representative studies confirm that LGBTQ individuals are at an elevated risk of experiencing intimate partner violence. While many similarities exist between LGBTQ and heterosexual-cisgender intimate partner violence, research has illuminated a variety of unique aspects of LGBTQ intimate partner violence regarding the predictors of perpetration, the specific forms of abuse experienced, barriers to help-seeking for victims, and policy and intervention needs. Les victimes sont aujourd'hui omniprésentes dans le champ pénal. Serait-ce le temps de leur revanche après qu'elles ont été complètement ignorées du Code d'instruction criminelle et trop longtemps oubliées du législateur ? La justice pénale n'est-elle pas entrée dans l'ère de la tyrannie de la victime ? L'heure est peut-être venue de tenter de faire le point sur la place de la victime dans le système pénal, en abordant la question non seulement sous l'angle juridique, mais aussi en fournissant quelques repères victimologiques et psychologiques. Ce n'est que dans une approche globale qu'un équilibre peut se dégager entre les différents protagonistes du procès pénal. Préciser les attentes de la victime par rapport à son avocat et à la justice, expliquer les facteurs de victimisation ainsi que les besoins de la victime, rappeler les moyens mis en oeuvre par la justice pénale pour les rejoindre, sans oublier l'inventaire des services mis à sa disposition... C'est à cette tâche que s'attelle la CUP, en privilégiant toutefois certains aspects de cette vaste problématique, en particulier la médiation, l'indemnisation et l'expertise.

"Domestic violence is commonly assumed to be a bipartisan, nonpolitical issue, with politicians of all stripes claiming to work to end family violence. Nevertheless, the Violence Against Women Act expired for over 500 days between 2012 and 2013 due to differences between the U.S. Senate and House, demonstrating that legal protections for domestic abuse survivors are both highly political and highly vulnerable. Racial and gender politics, the move toward criminalization, reproductive justice concerns, gun control debates, and political interests are increasingly shaping responses to domestic violence, demonstrating the need for greater consideration of the interplay of politics, domestic violence, and how the law works in people's lives. [This book provides an] historical perspective on domestic violence responses in the United States. It grapples with the ways in which child welfare systems and civil and criminal justice responses intersect, and considers the different, overlapping ways in which survivors of domestic abuse are forced to cope with institutionalized discrimination based on race, gender, sexual orientation, and immigration status. La victime a très longtemps été considérée comme un justiciable de seconde zone. Parent pauvre au procès pénal axé sur le prévenu, l’évaluation de son dommage n’est jamais apparue, au sein des universités, comme une matière noble et l’enseignement de cette évaluation a souvent été réduit à la portion congrue. Les choses ont changé à la faveur de l’évolution générale de la société vers une plus grande exigence de sécurité individuelle, financière et autre. L’œuvre de quelques grands juristes, le développement de l’assurance de responsabilité, certains faits divers pénibles, comme la catastrophe du Heysel ou l’affaire Dutroux, ont également contribué à cette évolution en sensibilisant le monde politique aux insuffisances de la situation. De nombreuses lois récentes ont dès lors cherché à améliorer le sort de la victime sous différents aspects. Il était temps de faire le point de sa situation, non sous l’angle de telle ou telle législation particulière, mais de manière en quelque sorte transversale, en plaçant la personne lésée au centre de l’analyse.Ttel était le but de la journée d’études dont le présent ouvrage est le fruit.Les différents rapporteurs envisagent chronologiquement tous les problèmes que rencontre la victime à la recherche de son droit à réparation : accès financier à la justice, place dans le procès civil et dans le procès pénal, déroulement de l’expertise judiciaire et évaluation même du dommage subi dans ses différentes composantes. Deux rapports ensuite examinent la situation de la victime dans l’espace, c’est-à-dire au regard des règles de droit international privé qui s’appliquent aux événements dommageables, et dans le temps, c’est-à-dire au regard des règles de prescription. Le but de la journée et de l’ouvrage qui en est issu est de dresser objectivement le bilan des réformes et d’émettre un certain nombre de propositions modestes mais pragmatiques d’amélioration des défauts qui les marquent.
