Abstract

Deze masterproef gaat over principes van deugdelijk bestuur in de non-profitsector. Dit is gebaseerd op de recente literatuur rond social governance. Binnen de gehandicaptenvoorzieningen wordt op zoek gegaan naar de stakeholders, hun belangen en potentiële belangenconflicten. Daarnaast wordt onderzocht hoe de voorzieningen maatregelen nemen om rekening te houden met alle stakeholders, alsook hoe de organisaties aantonen dat ze legitiem zijn. Tenslotte wordt bekeken hoe de organisaties in de raad van bestuur aantonen dat ze een optimale besluitvorming nastreven. Het doel is om een beschrijvend beeld te geven over hoe de organisaties in de gehandicaptenzorg er vandaag uitzien op het vlak van principes rond deugdelijk bestuur. Het onderzoek werd gevoerd met behulp van diepte-interviews die werden opgesteld na de grondige literatuurstudie. De interviews werden afgenomen bij respondenten die een leidinggevende functie bekleden binnen de voorzieningen voor gehandicapten. We zullen vaststellen dat de voorzieningen op verschillende vlakken al ver gevorderd zijn door principes van social governance te integreren in de organisatie.

Abstract

Mit dem Thema der »Social Governance« durch Recht und dem Zusammenspiel von materiellrechtlichen Standards und deren prozessualer Durchsetzung griff das Symposium eine Frage von herausragender wissenschaftlicher und praktischer Bedeutung auf. Bei der Verfolgung bestimmter rechtlicher oder sozialer Ziele hat ein Rechtssystem grundsätzlich zwei Optionen: Die Ausübung von Einfluss auf das Verhalten der Bürger durch präventive oder reaktive Instrumente. Das Verhältnis von präventiven und reaktiven regulatorischen Instrumenten ist ein Schlüsselelement für die Analyse und das Verständnis eines Rechtssystems.

Abstract

International Organizations (IOs) are important actors within global social governance. They provide forums for exchange, contention and cooperation about social policies. Our knowledge about the involvement of IOs varies significantly by policy fields, and we know comparatively little about the specific roles of IOs in social policies. This volume enhances and systematizes our understanding of IOs in global social governance. It provides studies on a variety of social policy fields in which different, but also the same, IOs operate. The chapters shed light on IO involvement in a particular social policy field by describing the population of participating IOs; exploring how a particular global social policy field is constituted as a whole, and which dominant IOs set the trends. The contributors also examine the discourse within, and between, these IOs on the respective social policies. As such, this first-of-its kind book contributes to research on social policy and international relations, both in terms of theoretical substantiation and empirical scope.

Abstract

The "Civil Code of the People's Republic of China" (CCP) was adopted on May 28, 2020, came into force on January 1, 2021, and is the first coherent codification of civil law in the history of the People's Republic of China. Thus, this new code is seen as a groundbreaking step towards eliminating the previously existing patchwork of single statutes. It is not only the subject of academic debate but also enjoys considerable attention in the press. Against this background, this book seeks to provide an overall structural assessment of this significant legislative change as well as the analysis of specific relevant practical issues entailed by the codification. With contributions by Prof. Dr. Yuanshi Bu, Prof. Dr. Ying Chi, Anne Sophie Ortmanns, Prof. Dr. Yeong-chin Su, Dr. Yiyue Wu, Prof. Dr. Jin Zhao and Prof. Dr. Qingyu Zhu. Abstract

Successful democracies throughout history--from ancient Athens to Britain on the cusp of the industrial age--have used the technology of their time to gather information for better governance. Our challenge is no different today, but it is more urgent because the accelerating pace of technological change creates potentially enormous dangers as well as benefits. Accelerating Democracy shows how to adapt democracy to new information technologies that can enhance political decision making and enable us to navigate the social rapids ahead. John O. McGinnis demonstrates how these new technologies combine to address a problem as old as democracy itself--how to help citizens better evaluate the consequences of their political choices. As society became more complex in the nineteenth century, social planning became a top-down enterprise delegated to experts and bureaucrats. Today, technology increasingly permits information to bubble up from below and filter through more dispersed and competitive sources. McGinnis explains how to use fast-evolving information technologies to more effectively analyze past public policy, bring unprecedented intensity of scrutiny to current policy proposals, and more accurately predict the results of future policy. But he argues that we can do so only if government keeps pace with technological change. For instance, it must revive federalism to permit different jurisdictions to test different policies so that their results can be evaluated, and it must legalize information markets to permit people to bet on what the consequences of a policy will be even before that policy is implemented. Accelerating Democracy reveals how we can achieve a democracy that is informed by expertise and social-scientific knowledge while shedding the arrogance and insularity of a technocracy.

Abstract

This open access book explores the role of the ILO (International Labour Organization) in building global social governance from multiple and mutually complementary perspectives. It explores the impact of this UN´s oldest agency, founded in 1919, on the transforming world of work in a global setting, providing insights into the unique history and functions of the ILO as an organization and the evolution of workers’ rights through international labour standards stemming from its regulatory mechanism. The book examines the persistent dilemma of balancing the benefits of globalization with the protection of workers. It critically assesses the challenges that emerge when international labour standards are implemented and enforced in highly diverse regulatory frameworks in international, regional, national and local contexts. The book also identifies feasible ways to achieve more inclusive labour protection, putting into perspective the tension between the economic and the social in the ILO’s second century of operation. It includes reflections on the work of the ILO World Commission on the Social Dimension of Globalisation by Tarja Halonen, who as President of Finland co-chaired the Commission with Benjamin William Mkapa, President of Tanzania. Written by distinguished experts and scholars in the fields of international labour law and international law, the book provides an insightful and in-depth analysis of the role of the ILO as an international organization devoted to decent work and social justice. It also sheds light on tripartism and its particular role in the work of the ILO, examining the challenges that a profoundly changing working life presents in terms of labour protection and social justice, and examining the transnational dimension of labour law. Lastly, the book includes a postscript by Nobel economics laureate Professor Joseph E. Stiglitz.
