Abstract

La mort de Charles II d'Espagne en 1700 et la guerre de Succession d'Espagne qui s'ensuit bouleversent toute l'Europe dont la carte en ressort transformée en 1714. Les monarchies de France et d'Espagne, longtemps rivales et concurrentes, sont devenues des alliées grâce à des souverains issus d'une même maison royale. L'ensemble de leurs relations est durablement modifié par cette alliance étroite que l'on ne tarde pas à dénommer « l'union des couronnes », nouveau cadre politique qu'il faut concevoir, mettre en pratique et défendre. Amelot de Gournay, ambassadeur de Louis XIV à Madrid, incarna la forme la plus aboutie de ces nouvelles relations. Cette étude retrace les objectifs, les succès et les échecs d'une politique à partir de sa mise en oeuvre durant un conflit qui fut aussi une guerre civile, motivé également par des impératifs commerciaux et coloniaux. Amelot de Gournay, embajador de Luis XIV en Madrid, fue la encarnación de las nuevas relaciones que establecieron las monarquías de Francia y España durante la Guerra de Sucesión tras la muerte de Carlos II en 1700. Este estudio examina los objetivos, éxitos y fracasos de una política a partir de su aplicación en un conflicto que también fue una guerra civil, motivada al mismo tiempo por imperativos comerciales y coloniales.

Abstract

Onderhandelaars vertonen opvallend veel menselijke trekjes die gekenmerkt worden door het gebruik van stereotypes, emotionele beslissingen en percepties die niet altijd met de objectieve realiteit overeenkomen. Het lijkt op een of andere manier dat men blind wil blijven voor de psychologische tendensen die een rol spelen bij het afwijken van rationeel gedrag. Omwille van deze tendens is het dan ook belangrijk om het menselijke gezicht van de onderhandelaar bloot te leggen en dieper in te gaan op hoe de menselijke psychologie onderhandelingen tot een irrationeel iets kan transformeren. Met deze kennis onder de arm kunnen we een beter zicht krijgen op hoe onderhandelingen voor te bereiden en meer realistische verwachtingen te hanteren. De bedoeling van het voorliggend boek is om meer inzicht te geven in belangrijke psychologische processen en fenomenen die onderhandelingsgedrag op zowel een rechtstreekse als onrechtstreekse manier kunnen beïnvloeden. De inzichten die besproken worden zijn gebaseerd op wetenschappelijk onderzoek uitgevoerd binnen de sociale psychologie en de gedragseconomie.

Abstract

Evangelos Raftopoulos explores international negotiation as a structured process of relational governance that generates international common interest between and among international participants and in relation to the international public order. He challenges prescriptive models of negotiation - developed in international relations and positivistic approaches to international law, which artificially separate treaties from negotiation in the name of 'objectivity' - and opens a window for looking at international negotiations from a novel, international law perspective. Using an interdisciplinary approach that incorporates law, philosophy, politics, and linguistics, he proposes a holistic, theoretical model of multilateral international negotiation that not only offers a 'subjective' view of international law in practice but also demonstrates the importance of understanding the horizontal normativity of international ordering. This work should be read by academics and practitioners of international law and negotiations, officials of international organizations, and anyone else interested in international law and international relations.

Abstract

Het domein van de buitengerechtelijke conflictafhandeling staat niet stil. Hoewel arbitrage en andere vormen van ADR er nog niet in geslaagd zijn (en er misschien nooit in zullen slagen) om de klassieke rechtbankprocedure te verdringen als leidend paradigma voor de oplossing van geschillen, neemt hun belang wel stelselmatig toe. Bovendien ondergaat het leerstuk ingrijpende wijzigingen ten gevolge van het toenemend belang van de digitalisering en de bescherming van persoonsgegevens. Dit boek heeft als doelstelling om de lezer inzage te bieden in een aantal tendensen en ontwikkelingen die verband houden met alternatieve methoden van conflicthantering. Abstract

Pour tous ceux que passionne le champ pluriel de la négociation, dans le monde francophone mais bien au-delà, Christophe Dupont (1922-2010) demeure une figure incontournable. Il a défriché des espaces innovants de recherche, inspiré une génération d’universitaires, conseillé des praticiens en entreprise comme dans le secteur public, et guidé d’innombrables étudiants, de tous âges. D’abord économiste au sein d’institutions internationales, Christophe Dupont a participé à d’importantes négociations avant de se tourner vers la recherche et l’enseignement, sans perdre contact avec les terrains de la négociation : entré en négociation, il n’en est plus jamais sorti, traçant de multiples sillons qui ont tenu leurs promesses. Pour honorer sa mémoire et sa contribution exceptionnelle à l’avancée des connaissances en négociation, universitaires et praticiens se sont réunis pour produire ce Liber Amicorum. Il se veut le reflet fidèle de ce que fut Christophe Dupont, et de ce qu’est la négociation : à la fois un champ de recherche mais aussi une pratique ancrée dans le terrain, qu’il s’agisse de l’entreprise, des relations sociales ou de la diplomatie.
