Abstract

In this thoughtful and engaging critique, geographer Martin W. Lewis and historian Kären Wigen reexamine the basic geographical divisions we take for granted, and challenge the unconscious spatial frameworks that govern the way we perceive the world. Arguing that notions of East vs. West, First World vs. Third World, and even the sevenfold continental system are simplistic and misconceived, the authors trace the history of such misconceptions. Who Owns our Bodies? identifies a crisis both in ethics and in empowerment as people face often neccessarily wretched choices. It seeks a framework of guidance for practical decision-making and focuses on two key issues. First who decides on an individual's quality of life and thus on their health care treatments? Second how can patients be empowered with a structure to enable choice, self-realization, self-reflection and self-responsibility? John Spiers with characteristic clarity and verve offers a fundamental choice between health care experienced as hierarchy and control and the alternative of choice and self-responsibilty. He argues that health care must rely on patients deciding how much power they have, not on professionals deciding how much to grant them.

Abstract

Mechanisms and standards exist to safeguard the health and welfare of the patient, but for electroconvulsive therapy (ECT)-used to treat depression and other mental illnesses-such approval methods have failed. Prescribed to thousands over the years, public relations as opposed to medical trials have paved the way for this popular yet dangerous and controversial treatment option. Doctors of Deception is a revealing history of ECT (or shock therapy) in the United States, told here for the first time. Through the examination of court records, medical data, FDA reports, industry claims, her own experience as a patient of shock therapy, and the stories of others, Andre exposes tactics used by the industry to promote ECT as a responsible treatment when all the scientific evidence suggested otherwise. As early as the 1940's, scientific literature began reporting incidences of human and animal brain damage resulting from ECT. Abstract

The last few years have witnessed an important expansion in the collection and processing of human biological samples and related information data. Biobanks - huge repositories of human biological specimens - have a strategic importance for genetic research, clinical care, and future treatments. However, biobanks are facing many major ethical, legal, and governance challenges, including informed consent, privacy, ownership, commercialization, and harmonization. In addition, forensic DNA-databases raise specific issues. These databases can be an important tool for the police services in their search for the perpetrator of a crime, yet this raises ethical questions with regard to the relationship between liberty and security. This book - a publication of the European Commission funded research project GeneBanC - offers a rich source of material on the ethical, legal, and governance aspects of clinical biobanks, population biobanks, and forensic biobanks. It's research will be of interest to policy makers, academics, and legislators.

Abstract

A legal and moral analysis of medical decision making on behalf of those with such severe cognitive impairments that they cannot exercise self-determination.In this book, Norman Cantor analyzes the legal and moral status of people with profound mental disabilities--those with extreme cognitive impairments that prevent their exercise of medical self-determination. He proposes a legal and moral framework for surrogate medical decision making on their behalf. The issues Cantor explores will be of interest to professionals in law, medicine, psychology, philosophy, and ethics, as well as to parents, guardians, and health care providers who face perplexing issues in the context of surrogate medical decision making.The profoundly mentally disabled are thought by some moral philosophers to lack the minimum cognitive ability for personhood. Countering this position, Cantor advances both theoretical and practical arguments for according them full legal and moral status. He also argues that the concept of intrinsic human dignity should have an integral role in shaping the bounds of surrogate decision making. Thus, he claims, while profoundly mentally disabled persons are not entitled to make their own medical decisions, respect for intrinsic human dignity dictates their right to have a conscientious surrogate make medical decisions on their behalf. Cantor discusses the criteria that bind such surrogates. He asserts, contrary to popular wisdom, that the best interests of the disabled person are not always the determinative standard: the interests of family or others can sometimes be considered. Surrogates may even, consistent with the intrinsic human dignity standard, sometimes authorize tissue donation or participation in nontherapeutic medical research by profoundly disabled persons. Intrinsic human dignity limits the occasions for such decisions and dictates close attention to the preferences and feelings of the profoundly disabled persons themselves. Cantor also analyzes the underlying philosophical rationale that makes these decision-making criteria consistent with law and morals.
