La loyauté est nécessaire dans tous les rapports de droit. Consistant à être correct vis-à-vis des autres et de soi-même, celle-ci envahit, pour ne pas dire frappe, les droits du xxie siècle au point d'en devenir l'un des éléments constitutifs. Le présent ouvrage propose d'aborder la loyauté et le droit au travers d'extraits de textes et de décisions de justice. Il le fait plus exactement, par un travail de synthèse, sous l'angle de thèmes comme la loyauté et la preuve, la loyauté vis-à-vis de soi-même ou de la loi, la loyauté en droit social et la loyauté en droit pénal international.

Athough "loyalty" is in itself a relatively modern term, as a phenomenon it has long been recognised as a fundamental element of social relationships. The essays collected in this volume address the concept of loyalty as it was understood in the Middle Ages, exploring the theme of loyalty from three separate angles - the ties between individuals (such as marriage or feudal ties), the ties between individuals and groups (for example, the role of the individual in their wider family), and the ties between institutions and groups (such as monastic orders or guilds) - and questioning how, when, and why the phenomenon of loyalty first developed. This volume, which draws together contributions from leading historians, explores how loyalty was manifested, both in public and in private, in the medieval world. Covering topics as diverse as religious orders, royal courts, and funeral customs, the essays collected here explore the interplay between loyalty and love, friendship, obedience, and justice, and question how the value of loyalty functioned both in theory and in practice across a range of social spaces. Together, these articles offer a unique new perspective on medieval society and provide a framework that also promises to be fruitful for future research.

Il n'est de fidélité sans échange. La fidélité suppose deux termes, deux individus, ou un individu et une société, une institution. Ce pacte dont les règles changent selon les époques, les lieux et les domaines, est constitutif de l'organisation humaine. Une ligne brisée, un parcours à obstacles. Il faut avancer, combattre, vaincre et revenir. Mais ce parcours suppose un but à atteindre; pas de fidélité, que ce soit dans un couple, une croyance, une vocation, sans horizon, sans mémoire. L'espion, l'amant, le croyant, le traducteur, l'exilé se trouvent confrontés aux mêmes questions : comment conjuguer la fidélité à soi-même et aux autres ? Pour être fidèle, combien de trahisons ?

Abstract: An extensive literature review, content analysis of interviews and a survey with cooperative members allowed to identify factors that affect loyalty: culture, price, profit, transparency, relationship and leadership. Among the main findings, the research found that members’ perception of “trust” is more supported on a calculative logic of relationship based on exchanges, prices and payment than on shared meanings with long-term perspectives guided by cooperative principles. The extensive bibliographical reference and emerging factors found can help other researchers to develop deeper understandings on loyalty of members to agricultural coops.
