International courts and judicial bodies play a formative role in the development of international humanitarian law. International Law and New Wars examines how international law fails to address the contemporary experience of what are known as 'new wars' - instances of armed conflict and violence in places such as Syria, Ukraine, Libya, Mali, the Democratic Republic of Congo and South Sudan. International law, largely constructed in the nineteenth and twentieth centuries, rests to a great extent on the outmoded concept of war drawn from European experience - inter-state clashes involving battles between regular and identifiable armed forces. The book shows how different approaches are associated with different interpretations of international law, and, in some cases, this has dangerously weakened the legal restraints on war established after 1945. It puts forward a practical case for what it defines as second generation human security and the implications this carries for international law.

L’originalité de l’ouvrage tient en l’analyse synthétique et pédagogique de l’ensemble du droit de la guerre, étrangère comme civile, dans tous les théâtres (terre, mer, air, cyber), aussi bien les auteurs, causes et buts (jus ad bellum), que les acteurs, instruments et modalités (jus in bello), y compris les sanctions à la violation des règles. L’ouvrage montre l’existence d’un droit de la guerre, dans ses règles primaires comme secondaires. Il existe des titulaires du droit de recourir à la force armée dans les relations internationales : états, Organisations intergouvernementales telles que l’ONU, Mouvements de libération nationale, autres groupes ou entités non étatiques reconnus comme belligérants. Il existe des causes ou buts licites de recours à la force armée dans les relations internationales : consentement de l’état territorialement compétent, légitime défense, sécurité collective et autorisation du Conseil de Sécurité des Nations Unies, luttes anticoloniales, postcoloniales et antiapartheid. S’ajoute la revendication d’un droit d’intervention, soit au nom de la protection du droit des peuples ou des droits de l’homme, soit au nom de la lutte contre le « terrorisme » ou la « prolifération » des « armes de destruction massive ». Il existe des délégataires du droit d’utiliser la force armée dans les relations internationales : les combattants légaux, c’est-à-dire les militaires (combattants réguliers) mais aussi les combattants irréguliers remplissant les conditions posées par les conventions. Il existe des instruments et des modalités licites d’usage de la force armée dans les relations internationales : c’est ce qu’indiquent le droit des armements et le jus in bello dans ses différents théâtres, terre, mer, air, cyber. Au droit de la guerre répond le droit de la neutralité. Quant à l’insurrection et la guerre civile, elles ne sont pas interdites par le droit international. Le conflit armé interne fait l’objet d’une réglementation ratione modi, cependant il pose deux problèmes : celui de la reconnaissance de belligérance ou d’insurrection, et celui de l’intervention des états tiers. Il existe enfin des sanctions à la violation des règles applicables du droit de la guerre, notamment la mise en oeuvre de la responsabilité réparatrice et punitive.

Colloques, articles, ouvrages… de nombreuses ressources renseignent sur les modes de gestion des conflits, qu’ils soient reconnus par le droit ou, bien plus nombreux, maintenus en marge de celui-ci. Peu, pourtant, interrogent l’objet même que ces modes prétendent ainsi « traiter ». L’ambition de cet ouvrage du Groupe de recherche interdisciplinaire sur les modes de gestion des conflits (USL-B, UCLouvain) est précisément d’interroger le conflit lui-même. Des regards disciplinaires sont, dans un premier temps, successivement posés sur le conflit et en offrent une grille de compréhension dans leurs propres champs. Comment chacune des disciplines envisagées appréhende-t-elle le conflit et qu’implique chacune de ces acceptations ? Des traits communs pouvant nourrir nos conceptions ou nos pratiques se dégagent-ils d’une telle mosaïque ? Une autre façon d’appréhender le conflit est ensuite proposée, axée cette fois sur la manière dont différents modes de « règlement » actuellement reconnus perçoivent le conflit : par leurs interventions, que nous disent-ils de celui-ci et que nous apprennent-ils de spécifique ?
