This book examines the globalization of the service industry and the radical alteration that this has caused to the role of government. It will be helpful to managers in service industries who wish to learn more about changes in the environment in which they operate, and it also is essential reading for government officials who deal with the services sector. Written by some of the most knowledgeable experts in the field, the book surveys the structure and evolution of several industries and evaluates the different governmental roles that each has necessitated.

The principle of non-discrimination is fundamental to the regulation of international trade in goods and services. In the context of trade in goods, the concept of 'like products' has become a key element of the legal analysis of whether a trade obstacle violates GATT non-discrimination obligations. The equivalent concept of 'like services and service suppliers' in GATS rules on non-discrimination has received little attention in WTO jurisprudence. In light of the remaining uncertainties, Nicolas Diebold analyses the legal problems of the GATS 'like services and services suppliers' concept using a contextual and comparative methodology. The 'likeness' element is not analysed in isolation, but in context with 'less favourable treatment' and regulatory purpose as additional elements of non-discrimination. The book also explores how far theories from non-discrimination rules in GATT, NAFTA, BITs and EC as well as market definition theories from competition law may be applied to 'likeness' in GATS.

The WTO is today dealing with an issue that lies at the interface of two major challenges the world faces, trade liberalization and international migration. Greater freedom for the "temporary movement of individual service suppliers" is being negotiated under the General Agreement on Trade in Services (GATS). Conditions in many developed economies - ranging from aging populations to shortages of skilled labor - suggest that this may be a propitious time to put labor mobility squarely on the negotiating agenda. Yet there is limited awareness of how the GATS mechanism can be used to foster liber

What are the major barriers to services trade? To what extent would further liberalisation of trade in services result in increased welfare gains and economic growth? Empirical evidence is also important to demonstrate the economic effects of market and regulatory changes as an aid to the design of adequate regulatory reform. Amongst other issues, the papers in this volume explore fundamental issues for empirical research on trade in services. It highlights the specific data requirements and conceptual challenges for modelling liberalisation of services.
