Abstract

À l’heure où les formes de la démocratie représentative sont interrogées de différentes
manières, que peuvent nous apprendre les
expériences de délibération communale développées au sein des
communautés urbaines médiévales et modernes ? Les registres de délibérations forment un corpus très abondant depuis la fin du Moyen Âge. Leur production, en Europe méridionale puis occidentale, a accompagné le développement des formes écrites de l’administration. Or, à l’échelle du gouvernement des sociétés médiévales et modernes, les écritures des conseils de ville permettent de pénétrer les processus de la prise de décision. Les études ici contenues interrogent la diffusion et l’adaptation locale des cultures politiques européennes. Elles prolongent les avancées les plus récentes de la recherche sur le pouvoir de l’écrit, sur un terrain nouveau. Il s’agit ici de la première synthèse sur les sources historiques sans doute les plus abondantes et les plus continues en histoire urbaine. Apparemment banals, les registres de délibérations ont été jusque-là utilisés par les historiens sans y prêter toute l’attention qu’ils méritaient. Cet ouvrage mutualise les approches méthodologiques. Le collectif de chercheurs réunis forge ainsi les outils d’un comparatisme européen, à l’échelle urbaine. La perspective choisie est celle de la longue durée, en examinant l’évolution politique et scripturale des institutions municipales du XIIIe au XVIIIe siècle.

Abstract

Fitzmaurice and the World Crisis examines the impact of the legal advice of G.G. Fitzmaurice on the making of British Foreign Policy during the key phases of the developing World Crisis, from 1932 to 1945, in relations with Japan and Germany. Particular attention is given to whether relations with Germany were defined in terms of classical power politics or in a new language of the rule of law in international society. The main themes highlight Fitzmaurice's contribution to the shaping of major issues and illustrate the breadth of scope in the work of the legal adviser: the Manchurian Crisis; Anglo-German relations in the 1930s; the concluding of the Anglo-Polish Treaty of 1939; economic warfare and the laws of war at sea (1939-43); debate surrounding the nature of Germany's surrender and the drafting of armistice terms. The book breaks new ground with respect to the basic technical crafts of the international lawyer. It shows how the skills of the diplomatic historian, working with unpublished Foreign Office archives, are essential to unravelling the true legal practice of a state as an element in the evolution of customary international law. The aim is not simply to unearth and present, in a minimally edited form, the legal opinions of Fitzmaurice, but also to assess his impact within the Foreign Office. It concludes that the role of the individual international lawyer in government institutions is potentially very significant. However, his influence depends not simply on the stubbornness with which he holds onto his professional expertise, but also on his moral vision and sensitivity towards the complexities of the context in which he has the potential to shape events.

Abstract

Mountains have occupied a central place in German, Swiss, and Austrian intellectual culture for centuries. This volume offers the first scholarly English translations of thirteen key texts from the Germanophone tradition of engagement with mountains. The selected texts span over 450 years, ranging from the early modern period to the postmodern era, and encompass several discursive modes of the mountain experience including geographical descriptions, philosophical meditations, aesthetic deliberations, and autobiographical climbing narratives. Well-known figures covered in this translational sourcebook include Conrad Gessner, Johann Jakob Scheuchzer, G.W.F. Hegel, Alexander von Humboldt, Georg Simmel, Leni Riefenstahl, and Reinhold Messner. Each text is accompanied by a critical introduction that places the translated text within a broader cultural context. The dual translational-interpretational approach offered in this volume is intended to stimulate new international and interdisciplinary dialogue on the cultural history of mountains and mountaineering.

Abstract

The relationship between an author's and an audience's intentions is complex but need not preclude mutual engagement. This philosophical investigation challenges existing literary and rhetorical perspectives on intention and offers a new framework for understanding the negotiation of meaning. It describes how an audience's intentions affect their interpretations, shows how audiences negotiate meaning when faced with a writer's undecipherable intentions, and defines the scope of understanding within rhetorical situations.Introducing a concept of intention into literary analysis that supersedes existing rhetorical theory, Arabella Lyon shows how the rhetorics of I. A. Richards, Wayne Booth, and Stanley Fish, as well as the hermeneutics of Hans-Georg Gadamer, fail to account for the complex interactions of author and audience. Using Kenneth Burke's concepts of form, motive, and purpose, she builds a more complex notion of intention than those usually found in literary studies, then employs her theory to describe how philosophers read Wittgenstein's narratives, metaphors, and reversals in argument.Lyon argues that our differences in intention prevent consistency in interpretations but do not stop our discussions, deliberations, and actions. She seeks to acknowledge difference and the communicative problems it creates while demonstrating that difference is normal and does not end our engagement with each other.Intentions combines recent work in philosophy, literary criticism, hermeneutics, and rhetoric in a highly imaginative way to construct a theory of intention for a postmodern rhetoric. It recovers and renovates central concepts in rhetorical theory—not only intention but also deliberation, politics, and judgment.
