Abstract

Claus Roxin's "programmatic work" on "criminal policy and the criminal law system" is communicated in this work as a legislative program. In doing so, the author is guided by the main theories of Roxin's work, according to which the facts of a case underlie the principle of clarity and definiteness of law, the category of unlawfulness shapes social conflict resolution with the help of regulatory principles, and with regard to the offense level of culpability, freedom of action and also preventive viewpoints must be considered. Abstract

Kriminalpolitische Zeitgeister setzen im Rahmen strafgesetzgeberischer Hyperaktivitäten immer häufiger auf das Prinzip ,in dubio Prognose'. Prognostischer Sachverstand und "Gutachterei" sollen die darauf gegründeten strafjustiziellen Entscheidungen wissenschaftlich und prozedural legitimieren - auch dem Betroffenen gegenüber, vor allem aber einer Allgemeinheit gegen-über, die geschützt werden will und soll. Nach Anmerkungen zur Aktualität und Brisanz dieser Thematik, zum Anspruch der Untersuchung und zur Terminologie stehen im Mittelpunkt der Untersuchung zunächst Fragen der Prognostik im Kriminalrecht und Aspekte der kriminalprognostischen Methodologie, bevor die Ergebnisse dieser Analysen im Spannungsfeld von Sicherheitsrecht und Rechtssicherheit bewertet werden.

Abstract

The central aim of "Assessing the Harms of Crime" is to provide a firm analytical foundation for making normative decisions about criminal and related policy, taking harm-and its reduction-as a conceptual starting point and supplying the means for systematic, empirical analysis in a harm assessment framework. By exploring harm's place in legal history and theory, criminology, and related fields and by considering the relevance of harm and its reduction for both criminal policy and the governance of security, the book demonstrates the centrality of harm, including its reduction, to crime, policy, and governance. It also highlights a substantial gap in methods available to the policy community to take on harm and the challenges of developing them. Working to fill that gap, the book presents the authors' "Harm Assessment Framework," consisting of tools and a process to identify, evaluate, and rank harms and to carefully distinguish harms that result directly from activities from those that are remote or driven at least partially by policy. The book also presents applications to complex crimes, primarily involving coca and cocaine, that show the framework's value with new, actionable insight to harm and policy. On this basis, the book argues that criminology would benefit from expanding its mission to include harm and target harm reduction and from positioning harm assessment as a core task. Lastly, it posits that systematic, empirical harm-based policy analysis can contribute positively to decisions about criminal policy and the governance of security and to advancing justice.

Abstract

This open access book provides the first-ever comparative study on criminal policy concerning the illicit trade of tobacco, conducted among four comparatively new EU Member States (Lithuania, Poland, Slovakia and Romania) and two “old” EU countries (Germany and Italy). The book addresses the national legal frameworks, current criminological situation regarding illicit trade of tobacco, and the practical challenges faced by national law enforcement authorities in the countries examined. It also considers the international framework, and concludes with a horizontal report. The objective of the book is to highlight legislative and practical challenges in the fight against illegal tobacco products at the national and transnational level, and to formulate recommendations for overcoming them more effectively in Europe.

Abstract

Why have American policies failed to reduce the racial inequalities still pervasive throughout the nation? Has President Barack Obama defined new political approaches to race that might spur unity and progress? Still a House Divided examines the enduring divisions of American racial politics and how these conflicts have been shaped by distinct political alliances and their competing race policies. Combining deep historical knowledge with a detailed exploration of such issues as housing, employment, criminal justice, multiracial census categories, immigration, voting in majority-minority districts, and school vouchers, Desmond King and Rogers Smith assess the significance of President Obama's election to the White House and the prospects for achieving constructive racial policies for America's future. Offering a fresh perspective on the networks of governing institutions, political groups, and political actors that influence the structure of American racial politics, King and Smith identify three distinct periods of opposing racial policy coalitions in American history. The authors investigate how today's alliances pit color-blind and race-conscious approaches against one another, contributing to political polarization and distorted policymaking. Contending that President Obama has so far inadequately confronted partisan divisions over race, the authors call for all sides to recognize the need for a balance of policy measures if America is to ever cease being a nation divided.
