This title provides a socio-legal perspective to critical military studies by asking socio-legal questions about military conscription in Turkey: How do the international and domestic laws approach the conflict between the law and conscience? Why does Turkey insist on the non-recognition of the right to conscientious objection? How are those pursuing their conscience affected by such non-recognition? These questions are important as the law is shaped by the socio-cultural structures in which it operates, and any attempt to create a social change also necessitates understanding and challenging the legal framework.

This wide-ranging and original book brings together four different bodies of knowledge to examine the pratice of conscientious objection: historical and philosophical analyses of conscientious objection as a critique of compulsory military service and militarization; feminist, LGBT and queer analyses of conscientious objection as a critique of patriarchy, sexism, and heterosexism; activist and academic analyses of conscientious objection as a social movement and individual act of resistance; legal analyses of the status of conscientious objection in international and national law.

This book explores the concept of 'freedom to obey' through a comprehensive analysis of moral, political, and legal theories related to conscience objection. It delves into the ethical crossroads faced by individuals, examining resistance, and the limits of obedience. The author aims to unpack the intricate dynamics of conscience in contemporary political contexts, especially in light of recent conflicts such as the war in Ukraine. By analyzing the intersections of moral values, public order, and individual conscience, the work offers a nuanced perspective on the ethical and legal dimensions of civil disobedience and conscience objection. The book targets scholars and students of law, ethics, and political science, providing a detailed theoretical framework to understand the evolving role of conscience in democratic societies.
