In 1794 and 1799 Superintendent of Convicts Nicholas Devine was granted 210 acres on the edge of the current CBD of Sydney. After the demise of Governor Bligh (to whom he was closely allied) Devine reluctantly retired to his estate where, as an old man living alone, he was constantly beaten and robbed. An Irish convict named Bernard Rochford befriended the old man in 1825 and upon his death in 1830 forged a Will and seized control of the estate and proceeded to subdivide it and sell it off. La réforme de la prescription en matière civile se justifiait-elle ? Au regard des critiques adressées au droit antérieur, pour l'essentiel inchangé depuis 1804, une réponse affirmative s'impose. La nature indéterminée de l'objet de la prescription, sa durée variable ainsi que la complexité de son régime constituaient une source d'insécurité juridique et de chaos. La loi du 17 juin 2008 est-elle parvenue à réguler ce désordre ? C'est ce que tend à déterminer cet ouvrage issu des actes du colloque organisé le 15 mai 2009 par l'Institut de l'Ouest : Droit et Europe (IODE), à l'Université de Rennes 1 avec le soutien du laboratoire THEMISUM de l'Université du Maine. Les différentes interventions ici réunies traitent, d'une part, des règles générales de la nouvelle prescription (nature, durée, régime, droit transitoire) et, d'autre part, des incidences de la réforme sur l'aménagement de la prescription, ainsi que sur le droit immobilier et le droit du dommage corporel. Les observations de François Terré, membre de l'Institut, clôturent le colloque.

Prescription is a major legal defence that bars civil actions on the claim after the expiry of a certain period of time. Despite its far-reaching practical effects on litigation and on society at large, and the fact that it is the subject matter of pervasive legal reforms in many countries, the law of prescription (limitation of actions) is rarely discussed, analysed and compared.00To meet this challenge, this book canvases in-depth the law of 15 selected jurisdictions (covering Europe, South Africa and the US jurisdictions) and extensively analyses in comparative perspective the elements of prescription (accrual of the cause of action, prescription periods, rules of suspension, renewal, extension, etc), their interrelations, and the policy considerations (including economic analysis). Topics also covered include the notions of?action?,?claim?, and?cause of action?, subjective and objective prescription, statute interpretation and judicial discretion. The book concludes with how the present law can be improved and where suitable harmonised.
