Abstract

The "Civil Code of the People's Republic of China" (CCP) was adopted on May 28, 2020, came into force on January 1, 2021, and is the first coherent codification of civil law in the history of the People's Republic of China. Thus, this new code is seen as a groundbreaking step towards eliminating the previously existing patchwork of single statutes. It is not only the subject of academic debate but also enjoys considerable attention in the press. Against this background, this book seeks to provide an overall structural assessment of this significant legislative change as well as the analysis of specific relevant practical issues entailed by the codification. With contributions by Prof. Dr. Yuanshi Bu, Prof. Dr. Ying Chi, Anne Sophie Ortmanns, Prof. Dr. Yeong-chin Su, Dr. Yiyue Wu, Prof. Dr. Jin Zhao and Prof. Dr. Qingyu Zhu. Das „Zivilgesetzbuch der Volksrepublik China“ (ZGB) wurde am 28.5.2020 verabschiedet, ist am 1.1.2021 in Kraft getreten und bildet die erste zusammenhängende Zivilrechtskodifikation in der Geschichte der Volksrepublik China. Damit wird das Regelwerk als ein wegweisender Schritt zur Beseitigung des zuvor bestehenden Flickenteppichs aus Einzelgesetzen gesehen und ist nicht nur Gegenstand akademischer Diskussionen, sondern erfreut sich auch in der Alltagspresse einer großen Aufmerksamkeit. Vor diesem Hintergrund ist zum einen die strukturelle Gesamtbewertung dieser gewichtigen Gesetzesänderung von Interesse, zum anderen stellt sich die Frage nach praktisch besonders relevanten Einzelfragen der Zivilrechtskodifikation. Abstract

Finnish-Swedish art historian Osvald Siren (1879--1966) was one of the pioneers of Chinese art scholarship in the West. This biography focuses on his four major voyages to East Asia: 1918, 1921--1923, 1929--1930, and 1935. This was a pivotal period in Chinese archaeology, art studies, and the formation of Western collections of Chinese art. Siren gained international renown as a scholar of Italian art, particularly with his books on Leonardo da Vinci and Giotto. Yet when he was almost forty years old, he became captivated by Chinese art (paintings of Lohans in the Museum of Fine Arts in Boston) to such an extent that he decided to start his career anew -- in a way. He has left his mark in several fields in Chinese art study: architecture, sculpture, painting, and garden art. This study charts Siren's itineraries during his travels in Japan, Korea, and China. It introduces the various people in those countries as well as in Europe and North America who defined the field in its early stages and were influential as collectors and dealers. Since Siren was a theosophist, the book also explores the impact of theosophical ideas in his work.

Abstract

This study is an attempt to reorient the field of Chinese linguistics from the perspective of the new field of cultural interaction studies. The author, approaching Chinese linguistics from the periphery, examines such topics as the spread of Western learning and linguistic contact and Westerners' study of Chinese: He studies materials produced by Western missionaries and Ryukyuan materials to show the validity and usefulness of Chinese linguistics in the field of cultural interaction studies. In addition, he looks at cultural interaction through illustrations.

Abstract

Abstract

This book examines the historical development of China’s collective presidency and identifies five key mechanisms which effectively reduce the asymmetries of knowledge and power. The mechanisms discussed are: group or collective succession, collective division of responsibilities and cooperation, collective learning, collective research, and collective decision making. This work presents many facts including historical details showing that the collective presidency of China is a unique and prodigious innovation of the Communist Party of China (CPC) and China’s socialist political system. We see how China’s political system stands in contrast to the presidential system that exists in the United States, which can be described as a system of personal responsibility of the president. The author identifies characteristics of the collective presidency and introduces a framework for analysis. Chapters then explore the phases of historical development in detail and examine fundamental features in terms of their historical development, operational characteristics and evaluation. The final chapter summarizes the political advantages of collective presidency, particularly international competitive advantages, and readers will discover that the route to success for modern China lies in collective presidency. This book will appeal to anyone who wishes to discover how China’s political system works, to explore its political institutions that operate in conjunction with the CPC and the Chinese state, or to discover how a collective presidency can work successfully.
