"This book places under scrutiny for the first time, whether, and how, the United Nations Human Rights Council actually contributes to the protection of human rights in the face of pervasive gross violations world-wide. It finds that the Council does little of preventive protection, some mitigatory protection, and little remedial or compensatory protection. The Council's response to situations of gross violations depends on the political alignments within its membership for each situation. The Council gives priority to cooperation and dialogue over principled denunciations of gross violations. It is not an organ of justice, but in some instances it is an organ for justice, inasmuch as it addresses the structural causes of violations. Much useful fact-finding takes place under the auspices of the Council, and it does contribute to the progressive development of international law"--

This book, based on the reports by Dr. Alfred de Zayas, the first mandate-holder (2012-2018), offers a brilliant and comprehensive critique of the UN system, addressing the changes that must be made in order to further the emergence of a democratic and equitable international order. De Zayas proposes concrete reforms of the UN system, notably the Security Council. He advocates recognition of peace as a human right, slashing military budgets, and establishing the right of self-determination as a conflict-prevention measure. As it concerns the global economy, he calls for reversing the adverse impacts of World Bank and International Monetary Fund policies, rendering free-trade agreements compatible with human rights, abolishing tax havens and ISDS, alleviating the foreign debt crisis, and criminalizing war-profiteers and pandemic vultures.

Abstract

The UN Human Rights Council is the leading human rights organ of the United Nations and, ten years after it was established, it has attracted commendation as well as severe criticism. Its universal periodic review is widely recognized as a valuable process of international cooperation to advance the universal implementation of human rights. However, it has been criticized for not acting effectively and fairly in dealing with situations of shocking violations of human rights in many parts of the world. It is an international organ with the highest responsibilities to uphold universal values but, at the same time, it is a political organ of United Nations Member States, and it shows the characteristics of both a values-based body and a theatre of political drama. It is the merit of this book to present the Human Rights Council in terms of its mandates, roles and organization while seeking to remind the membership and the international community at large that the Council must be anchored in the modern human rights law of the Charter - of which the author gives a superb presentation. The book then proceeds to make the case that human rights are part of international constitutional law and this is exceedingly important at a time when universal values have come under stress from various quarters including from terrorist formations. The argument of the book is essentially that the modern human rights law of the Charter and the human rights provisions of international constitutional law must take precedence for everyone, everywhere.

Abstract

The United Nations Special Procedures system is a key element of the evolving international framework for human rights protection and promotion. However, despite the system’s expansion, the range of roles and functions performed by mandate holders, and the mounting evidence of its strengths and limitations, there has been very little academic interrogation or analysis of Special Procedures. This lacuna is ever-more problematic given the growing profile and effectiveness of the Special Procedures’ work, as well as the increasing attention and challenges that they face, both externally from States and internally from within the UN system. Given the current ‘state of play’ of Special Procedures, it is essential that scholarly attention be focussed upon the system. How does it contribute to international human rights protection? How, when and why does it fail to do so? What steps can and should be taken to address shortcomings both within the system and in terms of the legal and political context within which it operates?
