This careful reading of six legal cases in American higher education is an essential primer for understanding contemporary litigation.Winner of the Steven S. Goldberg Award for Distinguished Scholarship in Education Law of the Education Law AssociationAlthough much has been written about U.S. Supreme Court decisions involving higher education, little has been said about the foundational case law and litigation patterns emerging from the lower courts. As universities become increasingly legislated, regulated, and litigious, campuses have become testing grounds for a host of constitutional challenges. From faculty and student free speech to race- or religion-based admissions policies, Suing Alma Mater describes the key issues at play in higher education law.Eminent legal scholar Michael A. Olivas considers higher education litigation in the latter half of the twentieth century and the rise of "purposive organizations,” like the American Civil Liberties Union and the Alliance Defense Fund (now known as the Alliance Defending Freedom), that exist to advance litigation. Abstract

This book raises fundamental questions about the propriety of continuing to use a premedical curriculum developed more than a century ago to select students for training as future physicians for the twenty-first century. In it, Dr. Donald A. Barr examines the historical origins, evolution, and current state of premedical education in the United States. One hundred years ago, Abraham Flexner's report on Medical Education in the United States and Canada helped establish the modern paradigm of premedical and medical education. Barr’s research finds the system of premedical education that evolved to be a poor predictor of subsequent clinical competency and professional excellence, while simultaneously discouraging many students from underrepresented minority groups or economically disadvantaged backgrounds from pursuing a career as a physician. Analyzing more than fifty years of research, Barr shows that many of the best prospects are not being admitted to medical schools, with long-term adverse consequences for the U.S. medical profession. The root of the problem, Barr argues, is the premedical curriculum—which overemphasizes biology, chemistry, and physics by teaching them as separate, discrete subjects. In proposing a fundamental restructuring of premedical education, Barr makes the case for parallel tracks of undergraduate science education: one that would largely retain the current system; and a second that would integrate the life sciences in a problem-based, collaborative learning pedagogy. Barr argues that the new, integrated curriculum will encourage greater educational and social diversity among premedical candidates without weakening the quality of the education. He includes an evaluative research framework to judge the outcome of such a restructured system.This historical and cultural analysis of premedical education in the United States is the crucial first step in questioning the appropriateness of continuing a hundred-year-old, empirically dubious pedagogical model for the twenty-first century.

Este libro está dedicado a la universidad como protagonista de cambios. El texto lleva a comprender la universidad como ámbito de la relación indivisible de organización-sistema, en donde el todo es más que la suma de las partes, y el producto es el conocimiento como fin, medio y fundamento para el desarrollo de la persona (sentido crítico) y la respuesta al entorno (razón instrumental). A lo largo del texto se va construyendo la imagen de la universidad-ecosistema productora de novedad, donde la única certeza es la incertidumbre y que, además está en permanente crecimiento espiral, que transforma su entorno apuntado a la construcción de la ciudadanía responsable y la persona libre; la espiral del conocimiento sin control de casualidad. Un ecosistema, como el de la universidad propuesta, se encuentra en permanente construcción y deconstrucción, es el comenzar que es crear permanentemente con el presente y el pasado que está ya asumido en el presente. Redescubrir la frescura natural de un ecosistema inmerso en la universidad, y la vivencia pura de comunidad, nos llevará de la mano a quienes presumimos de catedráticos, al origen más puro del conocimiento humano que tienen saber de vida, a la pureza refrescante de lo inédito y el valor auténtico de lo ingenuo, para que en ese instante seamos nosotros, comunidad en la que se autoorganiza y construye proyectos de vida, cultura y destino.

Abstract

Tertiary education is vital for producing the caliber and diversity of graduates needed both for the economy that exists today and for economy to which a nation aspires. It fuels competitiveness and growth by preparing professionals, like managers and engineers, medical personal and teachers. Universities are also centers of research and innovation and "working with small and medium size enterprises" support regional development. Tertiary education is both the aspiration of more and more young people around the globe and a fundamental requirement for employment in the industries that drive the global knowledge economy. As such, tertiary education provides unique opportunities for individual development and equality of opportunity as well as promoting shared prosperity. A failure to sustain effective tertiary systems can lead to perilous social upheavals, as youth fall outside the education system, unable to engage in active learning and uncertain about the future of their education and prospects. Societies are, then, confronted with a massive challenge of youth disengagement and deprived of the graduate professionals needed to keep countries on track for social cohesion and growth.

Over the last sixty years, Ireland has experienced profound economic, social, technological, occupational, cultural, and demographic changes. It has emerged from the most recent economic crisis stronger than ever and remains committed to its vision of a nation of people armed with the relevant knowledge, entrepreneurial agility, and analytical skills to support economic and social prosperity and to enhance the well-being of the country. Education has been at the heart of this transformation and has been a central component of Ireland's human capital development. Ireland's journey towards prosperity has not been without challenges, and some of these are acknowledged in this case study. The first part of the case study looks at the story of Ireland's remarkable economic and social transformations since the 1960s, with a focus on the contribution made by education. The opening section sets the context and notes a number of macroeconomic features that have contributed to the creation, maintenance, and development of a business environment that establishes Ireland as a cost-effective and attractive place to live and work The second section charts the story of education success in Ireland.

Abstract

Short-cycle higher education programs form skilled human capital in two or three years and are eminently oriented to the labor market. While they could play a key role in the upskilling and reskilling of the workforce required for employment recovery after the COVID-19 pandemic, they will only do so if their supply responds fast and nimbly to the skill needs to local labor markets. This paper studies the entry, competition, and turnover of short-cycle higher education programs (SCPs) in Colombia. It documents a large expansion in the number of programs over the past fifteen years and studies the frequency of program entry and exit. It finds that the market for SCPs is more dynamic than the market for bachelor's programs, as it exhibits greater turnover or "churn" of programs, with a significantly higher rate of program entry and exit in a given year. Exploiting data on local productivity and employment by field of study, the paper finds that SCPs are more responsive than bachelor's programs to changes in local labor demand. Among SCP providers, private and non-university institutions respond the most to the local economy. SCP entry is deterred by the presence of competitors and responds to cost considerations, particularly among private institutions. For a given institution, exit and entry decisions are highly correlated within a field of study. While enrollment is sensitive to the number of competitors, institutions differentiate their product by tuition, field, and geographic coverage. Overall, the evidence suggests that SCPs might indeed respond fast and nimbly to the local labor market needs created by the pandemic.

Os artigos aqui reunidos possibilitam o acesso aos resultados da pesquisa realizada sobre o ensino superior e o desenvolvimento regional: reconfigurando as relações entre as cidades e o campo. Dentre esses destaca-se a importância das políticas governamentais que promoveram a ampliação do ensino superior tanto através da criação de instituições de ensino superior federais, como de ensino técnico (IFs), mas também da rede privada que também se beneficiou de tal política. Tais repercussões vão além das cidades e municípios estudados, uma vez que atingem diretamente os municípios da região, mas também municípios de diferentes unidades federativas desde o sistema de acesso SISU. Acrescenta-se que o conjunto de textos que compõe este livro é apenas um registro da importância da temática eleita e da necessidade de se pesquisar a problemática abordada sob diferentes perspectivas analíticas, trata-se, pois, de um convite à continuidade da pesquisa.
