Recent years have seen a radical increase in incidents of jihadist terrorism within the United Kingdom - from the Westminster and London Bridge attacks to the Manchester Arena suicide bombing. As a result, there are renewed calls for a high-level national conversation about the causes of, and the responses to, this particular terrorist problem. Abstract

"Utilising an innovative analytical framework, this book provides a qualitative analysis of the costs and benefits of the counter-terrorism policy of the UK and the USA. Since 9/11 both the USA and UK have significantly revamped their counter-terrorism approaches. The approaches apply, to varying degrees, three key policy instruments - intelligence, law enforcement and military force. However, the success or failure of these counter-terrorism strategies has never been satisfactorily validated. Analysts and policymakers alike have assumed their success due to the absence of the recurrence of a terrorist attack directly upon either state, despite the fact that such a quantitative assumption fundamentally underestimates the impact of transnational terrorism. This volume provides an in-depth qualitative assessment of the three primary policy instruments implemented to counter the transnational threat of terrorism during the period 2001-2009; an approach somewhat neglected by the current body of literature which focuses on a purely quantitative methodology. Drawing upon previously unpublished data collected from interviews with policymakers, specialists and academics, US-UK Counter-Terrorism after 9/11 fills this lacuna by ascertaining and analysing the costs and benefits of the UK's and USA's counter-terrorism strategies and developing a holistic approach to understanding these strategies. Abstract

In the aftermath of a terrorist attack political stakes are high: legislators fear being seen as lenient or indifferent and often grant the executive broader authorities without thorough debate. The judiciary's role, too, is restricted: constitutional structure and cultural norms narrow the courts' ability to check the executive at all but the margins. The dominant 'Security or Freedom' framework for evaluating counterterrorist law thus fails to capture an important characteristic: increased executive power that shifts the balance between branches of government. This book re-calculates the cost of counterterrorist law to the United Kingdom and the United States, arguing that the damage caused is significantly greater than first appears. Donohue warns that the proliferation of biological and nuclear materials, together with willingness on the part of extremists to sacrifice themselves, may drive each country to take increasingly drastic measures with a resultant shift in the basic structure of both states.

Abstract

Located within wider debates about ‘security versus liberty’ in our post 9/11 world, the book analyses the new landscape of UK counter terrorism powers and offences and focuses upon the deleterious consequences of the so-called ‘war on terror’ on freedom of political expression and association. Questioning the compatibility of recent speech-limiting measures with liberalism’s established commitment to free speech and international human rights norms, the book takes a critical look at new powers to proscribe ‘extremist’ political parties, possession offences and other criminal controls (eg. Official Secrets Act prosecutions) as well as new offences such as ‘glorification’ of terrorism. Less visible, extra-legal forms of censorship are also evaluated. The monograph concludes by asking how a more vigorous defence of unorthodox and unpopular forms of expression might be safeguarded in the UK.
