Cet ouvrage cerne de plus près le concept de proportionnalité évoqué par certains et ensuite le principe de proportionnalité évoqué par d’autres en vue de voir si ces instruments peuvent justifier de manière cohérente certaines limites du droit de grève.Il traite du conflit permanent entre ceux qui exercent ce qui est aujourd’hui reconnu comme un « droit », le droit de grève, et ceux qui le subissent et qui peuvent faire valoir d’autres droits de valeur. L’auteur se préoccupe de savoir si le principe de proportionnalité en tant que mode de résolution des conflits peut donner une solution satisfaisante à ce conflit entre les différents droits en abordant non pas les aspects sociologiques de la grève mais exclusivement les aspects juridiques

"This monograph is a direct response to the claim made by members of the 'Employers Group' at the 2012 International Labour Conference, namely that the right to strike is not protected in international law, and in particular by ILO Convention 87 on the right to freedom of association. The apparent aim is to sow sufficient doubt as to the existence of an internationally protected right so that governments might have a free hand to limit or prohibit the right to strike at the national level while still claiming compliance with their international obligations. Already, some governments have seized on the employers' arguments to deny this right in law and in practice. The book is the only exhaustive analysis as to the existence of the right to strike under international law, and its findings, based on deep legal research, dispel any doubt on the matter. There is simply no credible claim that the right to strike does not enjoy international protection; indeed, the authors argue that it has attained the status of a customary international law norm"

Als op de luchthaven het werk enkele uren wordt neergelegd, dreigen advocaten met processen en grote schadeclaims. Een staking van het personeel van de NMBS, na agressie tegen een spoorwegbeambte, roept prompt reacties op van politici die een minimumdienstverlening eisen. Als vakbonden bedrijventerreinen afsluiten organiseren werkgeversorganisaties het juridische verzet. De aanvaarding van de staking als drukkingsmiddel is echter een teken van beschaving. Enkel in dictaturen wordt het niet getolereerd of zodanig ingeperkt dat het enkel met goedkeuring van de politieke overheid of het zakenleven kan ingezet worden. Het feit dat in België deze vorm van sociale actie steeds vaker op onbegrip stuit, baart zorgen. (bron : covertekst)
