Das Handbuch bietet erstmals eine systematische Darstellung der Staatshaftungssysteme in den EU-Mitgliedstaaten sowie in der Schweiz und der Türkei. Gemeinsamkeiten und Unterschiede in den verschiedenen Rechtsordnungen der europäischen Staaten werden aufgezeigt, in den Kontext des Unionsrechts gestellt und Ansätze für ein künftig einheitliches Staatshaftungsrecht skizziert. Das Werk enthält zum einen mehr als zwanzig Berichte über die Staatshaftungsregimes in den Einzelstaaten; zum anderen erläutert ein übergreifender Sachbericht den gesamteuropäischen Kontext und zieht vergleichende Schlussfolgerungen zu den einzelnen Sachthemen. Aus der Zusammenschau der nationalen Staatshaftungssysteme mit dem Stand der richterrechtlich entwickelten Unionshaftung wird das Staatshaftungsrecht in der EU umfassend analysiert sowie seine Entwicklungsmöglichkeiten auf der Grundlage allgemeiner Rechtsgrundsätze bestimmt. This reference work provides a systematic presentation of the liability systems in EU member states for the first time. Similarities and differences between EU states' various legal systems are presented and also explained in terms of Union Law. In addition, approaches to establishing a uniform state liability law in the future are outlined. This work includes, on the one hand, more than twenty reports about the state liability systems in the individual member states; on the other hand, comprehensive specialized report explain the entire European context and present comparative conclusions on the individual specialized topics. Based on the synopsis of the state liability systems together with the current state of Union liability as developed in case law, the law on state liability in the EU is extensively analyzed and its capability to develop based on general legal principles is defined.

The law of international responsibility, a classic area of investigation in international law, has been attracting an ever increasing interest in recent times, as reflected also in the work of the International Law Commission on State responsibility and on responsibility of international organizations. The exploration of current trends in this important area is therefore an appropriate and timely subject for a book in memory of Oscar Schachter, a former United Nations official, Columbia Law School professor, ASIL President, and international lawyer of world-wide reputation, who died in December 2003. The editor of the book has assembled a team of thirty-six prominent international lawyers belonging to twenty different nationalities to write about different aspects of the law of international responsibility, from general issues to specific areas of the law (including responsibility before international courts and tribunals), with respect to both the law of State responsibility and responsibility of international organizations and other non-State actors. The result of this effort is a monographic volume (enriched by a biography and a list of publications of Oscar Schachter, and accompanied by a bibliography of all the works cited in the various contributions and an index for easier consultation), which will be of interest not only to the many admirers and friends of Oscar Schachter around the world, but also, more broadly, to international law academics and practitioners.

One of the major innovations made by the Economic Community of West African States (ECOWAS) is the unequivocal granting of a supranational role to the Court of Justice of the organisation. However, its human rights mandate has led to real and potential tensions within the ECOWAS legal order. The tensions stem from the legal force of judgements of constitutional courts of member states and the admissibility of individual petitions before the Court. This work identifies some deficiencies in the current regime of the human rights mandate of the Court. Gaps exist at the level of the member states' constitutional order, as well as at the community level. The supranational competence of the jurisdiction must be implemented by the possibility of ordering concrete measures to be taken by states for the reparation of human rights violations. Innovative solutions are suggested in this work in order to fill procedural and substantial gaps in the protection system established in West Africa.
