Le Mercosur existe depuis 1991, mais initialement la doctrine a été largement absente des questions relatives à l'incorporation et à la mise en oeuvre de son droit par les États membres. Cela s'explique en raison du caractère limité de l'union douanière et des fonctions réduites dévolues aux institutions mercosuriennes.Néanmoins, l'approfondissement du Mercosur, qui n'est plus limité aux objectifs purement économiques, implique que le rôle de ses États membres devienne plus important. C'est la raison pour laquelle cette étude s'est intéressée au phénomène de l'incorporation et de la mise en oeuvre de ses normes dérivées tant du point de vue général, que de celui de l'exercice de la mise en oeuvre par les États membres, en particulier par le Brésil.L'objectif ici est d'évaluer, selon une méthode comparative avec le droit de l'Union européenne, comment le Mercosur tente d'encadrer la liberté des autorités nationales pour pouvoir ensuite vérifier si ces règles communes, qui se montrent singulièrement complexes, imprécises et éparses, sont respectées par le Brésil lorsque celui-ci est supposé agir en tant que relais d'exécution du droit du Mercosur.Il s'agit donc d'observer la pratique actuelle, à l'aide d'une étude sur le terrain, afin de pouvoir en identifier les défaillances et les solutions juridiques possibles, sans négliger l'influence de la politique sur le droit d'une organisation qui reste essentiellement dominée par les pouvoirs exécutifs nation
