People across the globe engage in social and solidarity economics to help themselves, their community, and society on their own terms. 'Community Economies in the Global South' examines how people who conscientiously organize rotating savings and credit associations (ROSCAs) bring positive changes to their own lives as well as others. ROSCAs are a long-established and well documented practice, especially those organized by women of colour. Members make regular deposits to a fund as a savings that is then given in whole or in part to each member in turn based on group economics. This book spotlights women in Latin America, the Caribbean, Africa, and Asia who organize and use these associations, composed of ordinary people belonging to similar class origins who decide jointly on the rules to suit the interests of their members.

La clause d'accroissement, ou tontine, en organisant une jouissance indivise d'un bien commun et une acquisition non translative de propriété au dernier survivant, dévoile un mécanisme complexe qui oscille entre communauté et indivision. La clause peut-elle valablement écarter l'indivision pour exclure le droit au partage alors qu'elle met en oeuvre une jouissance indivise ? En l'absence d'indivision, qui est alors propriétaire du bien avant le dénouement attendu de la propriété exclusive du survivant ? Le bien acquis en commun, inaliénable et insaisissable durant la période d'incertitude, peut-il valablement être soustrait du commerce juridique ? Autant d'énigmes que les règles, qui selon la Cour de cassation régissent la clause, ne parviennent pas totalement à élucider.L'intrusion du mécanisme de la propriété conditionnelle dans la clause, qui visait à effacer le transfert litigieux, a éclipsé la technique de l'accroissement, dont l'effet déclaratif permet justement de perpétuer une communauté comme d'y mettre fin sans transfert. Sa redécouverte réconcilie le régime et la nature de la clause. Si la clause institue une communauté provisoire ancrée dans le modèle conceptuel individualiste de l'indivision, son génie est d'offrir une assise technique et théorique à la propriété collective et aux communautés.A ce titre, elle est un témoin privilégié des transformations de la propriété.

Niet enkel geven diverse samenlevingsvormen aanleiding tot creatieve rechtspraak, maar bovendien worden er wetgevende initiatieven genomen tot grondige herziening van het traditionele huwelijksvermogensrecht en erfrecht. In dit werk wordt eerst een overzicht gegeven van de recentste ontwikkelingen in het relatievermogensrecht, met bijzondere aandacht voor de regels van de rechtspleging, de kwalificatie van huwelijksstelsels, de baten van het eigen of het gemeenschappelijk vermogen, de lasten van het eigen of het gemeenschappelijk vermogen, het bestuur van het vermogen, evenals de ontbinding, vereffening en verdeling van het vermogen, de verdeling tussen echtgenoten en – tot slot – de bedingen van aanwas en tontine. Vervolgens wordt stilgestaan bij de behandeling van schenkingen bij de vereffening en verdeling.
