The aim of this book is to create a space for contributions on religious freedom in the Global South. The contributions speak to diverse themes underscoring religious freedom in the Global South including the impact of religious freedom on majority and minority religious communities, the relationship between religious freedom and the state, and the relationship between religious freedom and other fundamental human rights. Through the adoption of inter- and multidisciplinary approaches, and with reference to various religions such as Islam, Hinduism, Sufism, Sikhism, and Christianity, contributors address the themes across several regions in the world including Africa, South Asia, South-East Asia, South America, and Eastern Europe. Depending on the social, legal, and political context and by relying on diverse examples such as the Muslim call to prayer (adhan), domestic violence, animal sacrifice, religious conversions, abortion, the rights of LGBT persons, and religious education in the public sphere, the contributions illustrate how religious freedom can undermine or promote the rights of majority or minority religious communities, and how it can impact on the rights of marginalised members within minority religious communities.

Though conditioned by the specific circumstances of eleventh-century Europe, the launching of the crusades presupposed a long historical evolution of the idea of Christian knighthood and holy war. Carl Erdmann developed this argument first in 1935 in a book that is still recognized as basic to an understanding of how the crusades came about. This first edition in English includes notes supplementing those of the German text, a foreword discussing subsequent scholarship, and an amplified bibliography. Paying special attention to the symbolism of banners as well as to literary evidence, the author traces the changes that moved the Western church away from its initial aversion to armed combat and toward acceptance and encouragement of the kind of holy war that the crusades would represent: a war whose specific cause was religion. Erdmann's analysis stresses the role of church reformers and Gregory VII, without neglecting the "popular" idea of crusade that would assure an astonishingly enthusiastic response to Urban II's appeal in 1095. His book provides an unrivaled account of he interaction of the church with war and warriors during the early Middle Ages. Carl Erdmann (1898-1945) taught at the University of Berlin and was associated with the Monumenta Germania historica. Marshall Baldwin was Professor Emeritus of History at New York University at his death in 1975. Walter Goffart is Professor of History at the University of Toronto. Un plaidoyer pour une neutralité de l’État au contenu juridique clairement définiLe principe de neutralité est, en Belgique, source de constantes polémiques dans la société, le monde politique et l’univers juridique. Le débat se focalise sur le port des signes convictionnels et particulièrement sur celui du foulard islamique. Se posent des questions de principe dont la plus importante est de savoir si la liberté de religion doit bénéficier d’un traitement privilégié par rapport aux autres droits et libertés et si la lutte contre les discriminations consiste à permettre à chacun d’adopter le comportement qui épouse au plus près ses convictions ou s’il faut édicter des règles générales applicables à tous impliquant des concessions réciproques.L’auteur analyse cette question à travers la jurisprudence des juridictions suprêmes nationales et internationales, dans l’enseignement, l’administration publique, le secteur privé et l’espace public. Sa conclusion sur le port des signes convictionnels est sans appel : « Il est permis d’interdire ». La Belgique, pays dans lequel il n’existe pas de religion d’État, place sur le même pied la liberté de culte et la liberté de manifester ses opinions en toute matière. Ce qui est autorisé ou interdit au nom de la liberté de la religion doit l’être au nom de n’importe quelle opinion philosophique, politique ou idéologique.Au-delà de la réflexion sur le port de signes convictionnels, l’auteur, qui s’autorise quelques digressions sur des épisodes nationaux, sur le modèle français ou sur le modèle canadien, explore les contours de neutralité de l’État en Belgique, en ce qu’elle se différencie de la laïcité à la Française. Sa conclusion est nette : le modèle belge est carbonisé. Au regard de la jurisprudence internationale, l’autorité publique ne peut plus s’autoriser à financer certains cultes, et ne pas en financer d’autres. Il ne peut plus non plus être question de réserver un sort favorable au culte catholique qui n’a d’autre légitimité – et une légitimité bien insuffisante – que son ancrage historique.L’auteur estime qu’il convient désormais de traduire dans la Constitution non seulement la primauté de la loi civile sur la loi religieuse, mais également une neutralité de l’État au contenu juridique clairement défini, à savoir la liberté de chacun de vivre, dans la sphère intime, dans le respect de ses convictions religieuses ou philosophiques et l’interdiction de toute ingérence de l’État dans les cultes. L’État est le bien de tous. Il doit être neutre et impartial dans son action comme dans son apparence, dans ses contacts avec les citoyens comme dans son fonctionnement interne.
