Abstract

Europe has the most advanced regional protection regime in the world. The predicted impact of this body of norms, including the new Common European Asylum System, has been widely identified as one that will have a 'ripple effect' beyond the EU. However, very few studies have noted the fact that this regime has already influenced the law and practice of states around the world, for some time. The purpose of this book is to gather evidence that emulation is happening (if it is), to explore the extent and identify the processes through which it is happening, and to examine the implications of these findings. A review of seven case studies reveals all but one of these cases provides clear evidence of emulation at some point in time. The EU protection regime, which has been most influenced by the European Court of Human Rights, is 'naturally' evolving transnationally and spreading internationally.

Abstract

En quoi la mutation de la question des réfugiés au début du xxe siècle provoque-t-elle son entrée dans le champ des relations internationales ? En quoi peut-on alors parler des débuts d’une diplomatie humanitaire en temps de paix concernant les réfugiés ? Comment l’étude de la scène proche-orientale et des plans d’établissement de la Société des Nations dans les années vingt permet-elle de saisir sur le terrain la nature et les limites de cette diplomatie ? Voici quelques-unes des questions posées par cet ouvrage qui contribue à la socio-histoire des relations interna­tionales, fondée sur une approche pluridisciplinaire des migrations forcées au XXe siècle. Dans le Proche-Orient des années 1918-1923, les réfugiés en Glide, Syrie et Liban s’intègrent dans la politique orientale de la France comme éléments de la stratégie de guerre, puis des rivalités territoriales et enfin, après 1921, du jeu minoritaire. La mise en pratique des plans interna­tionaux d’établissement des réfugiés arméniens puis assyriens en Syrie et au Liban entre 1927 et 1938, l’intervention du Comité international de la Croix-Rouge lors de la révolte druze (1925-1926) permettent d’analyser les lignes de force qui traversent le réseau humanitaire européen. Plus généralement, la réflexion menée interroge la mutation qui affecte la question des réfugiés au lendemain de la Première Guerre mondiale : mouvements de masse, essor sans précédent de l’apatridie, dénationalisations forcées, dans un contexte marqué par la nationa­lisation des sociétés européennes et l’augmentation de l’intervention étatique.

Abstract

The human and political problems presented by refugees and asylum are acute and are not improving. This is reflected in international concern and the existence of a treaty framework. The emergent body of refugee law is an amalgam of international, regional and national rules and procedures. But it is national law and practice, particularly with regard to immigration, which in reality determines an individual's right to asylum. The key to a true appreciation and understanding of the plight of refugees and the extent of their current rights therefore lies in national law and practice. This text is a comparative study of the relevant law and practice of six European States. It supplies some essential groundwork for the development of common law and policy in this vital area within the enlarged European Union.
