Marital rape stands at the intersection of the socio-legal issues arising from both domestic violence and sexual assault. For centuries, women who suffered sexual assault perpetrated by their spouses had no legal recourse. A man's conjugal rights included his right to have sexual intercourse with his wife regardless of whether she consented. This right has been recognised in law, and still is in some jurisdictions today. This book emerges from the research undertaken by an innovative, multi-country, academic, collaborative project dedicated to comparatively analysing the legal treatment of sexual assault in intimate relationships, with a view to challenging the legal impunity for and inadequate legal responses to this form of gendered violence

Increased attention to intimate partner rape has resulted in clinical studies and population-based survey research. Tellis examines the situational context of intimate partner rapes reported to the police. This study seeks to make sexual assault visible in domestic violence by using extant typologies to examine the control context and co-occurrence of physical and sexual assault in intimate partner rape. Findings reveal a predominance of Intimate Terrorism and gratuitous physical violence in over half of the cases, but suspects use threats to foster victim compliance in the majority of cases.

Selon des représentations bien ancrées dans les esprits, le viol est commis dans un lieu isolé par un inconnu violent et armé. Pourtant en France, 9 fois sur 10, la victime connaît l'agresseur et dans ce cas une fois sur deux, le violeur est le conjoint ou un ex-conjoint. Depuis longtemps, le viol est considéré en France comme un crime. Le viol conjugal faisait exception. Le mari avait le droit d'avoir des rapports sexuels avec sa femme, y compris contre la volonté de cette dernière et par la force. Depuis la loi du 4 avril 2006, le code pénal reconnaît le viol entre conjoints comme un viol aggravé. Pourtant, les victimes portent rarement plainte et lorsqu'elles le font, les affaires sont souvent jugées, non pas en cour d'assises comme tous les crimes, mais au tribunal correctionnel. Le viol conjugal est occulté par son invisibilité, lorsqu'il a lieu entre les murs d'un domicile commun. Comme les autres violences sexuelles, il laisse peu de traces visibles : ni bleu, ni plaie. Le viol conjugal, crime du quotidien, est à l'opposé du fait divers. Peu propice aux raccourcis accrocheurs, le sujet est éclairé par les contributions d'un collectif multidisciplinaire associant médecins, psychologues, sociologues et juristes. Ce livre montre l'urgence d'un infléchissement des pratiques judiciaires.
