The principle of proportionality is one of the cornerstones of International Humanitarian Law. Almost all states involved in armed conflicts recognize that it is prohibited to launch an attack that is expected to cause incidental harm to civilians that exceeds the direct military advantage anticipated from the attack. This prohibition is included in military manuals, taught in professional courses, & accepted as almost axiomatic. Yet, the exact meaning of this principle is vague. Almost every issue is in dispute. Controversy is especially rife regarding asymmetrical conflicts, in which many modern democracies are involved. How exactly should proportionality be implemented when the enemy is not an army, but a non-state actor embedded within a civilian population? What does it mean to use precautions in attack, when almost every attack is directed at objects that are used for both military & civilian purposes?

"Every year, the European Court of Human Rights delivers a large number of judgments, adding to its already extensive case-law. This makes it difficult for people outside the Court to know which cases are the most relevant and break new ground for fair trial issues. This book seeks to respond to that need by focusing on the most important cases and aims to make the content of Article 6 accessible in order to best serve readers' every-day practical legal needs. The cases are selected following the Court's Jurisconsult's opinion of their jurisprudential interest. Nul ne peut ignorer l’importance des principes généraux dans toutes les branches du droit.Le temps de leur émergence est désormais révolu, place à la compréhension de leurs développements récents.Le droit administratif est un terreau important pour une variété de principes généraux dont les principes dits de bonne administration. Ces principes ne sont cependant pas à l’abri de controverses doctrinales et jurisprudentielles, notamment à propos de leur reconnaissance ou de leur contenu.Or, ces principes se diffusent dans des domaines où l’administration intervient également, mais avec des spécificités (notamment juridictionnelles), tels le droit social et le droit fiscal. Le temps est donc venu de tenter de jeter des ponts entre ces matières, en particulier à l’intention des praticiens, et sans oublier l’influence grandissante du droit européen sur la reconnaissance et le régime de ces principes généraux dans le droit national.Un recyclage transversal est à cet égard proposé, qui permettra de comparer, à partir de la jurisprudence récente, une série de principes essentiels (tels par exemple la légitime confiance, le contradictoire, la bonne administration, la minutie, la proportionnalité, etc.) dans les trois branches du droit, mais aussi les principaux éléments de leur régime juridique (règles de reconnaissance, débiteurs, place dans la hiérarchie des normes, etc.)
