The European Union is on its way to establishing a completely harmonized private international law. In January 2009, the Rome II Regulation took effect as the first of several regulations containing provisions concerning the special part of private international law. However, a uniform application of these provisions will only be assured if the member states of the EU also agree on how to solve problems of the general part of private international law. Carmen Christina Bernitt analyzes the highly disputed issue of preliminary questions and shows how the specifics of a European private international law influence the problem of preliminary questions. She proposes a uniform solution and verifies this by examining several preliminary questions which will arise with the application of the Rome II Regulation.

La commémoration du cent cinquantième anniversaire de la réunion de la Savoie et du pays niçois à la France, par le traité de Turin du 24 mars 1860, a été l'occasion de prendre quelque recul devant cet événement, et de présenter différents rattachements pacifiques de territoires à la France, du Moyen Âge jusqu'en 1860, en soulignant leurs différents contextes historiques et leurs diverses modalités. Ces rattachements ou réunions n'ont pas eu lieu dans le sang et les larmes, ce qui ne veut pas dire sans tensions ni débats, pendant et après les événements. La grille d'analyse qu'ont affrontée les participants à ce volume est claire. Comment ces rattachements « pacifiques » sont-ils survenus ? Quel a été leur moteur premier ? L'élan fut-il donné par une élite ou porté par l'ensemble des classes sociales ? Quels furent les termes employés pour définir ces réunions ? Quelle fut l'idéologie (politique, culture, langue), ou - si l'on préfère - la culture politique, qui les a soutenus ? Venait-elle, cette idéologie, de la France elle-même ou des pays « réunis » ? Quels furent les symboles qui les accompagnèrent ? Quelles conséquences ces réunions ont-elles eu sur la conscience des pays réunis quant à leur spécificité historique ? En un mot, du Moyen Âge au XIXe siècle, un comparatisme raisonné de ces rattachements était-il possible ? The commemoration of the 150th anniversary of the annexation of Savoy and of the county of Nice through the treaty of Turin, which was signed on March 24, 1860, has provided the opportunity to see this event in perspective and to analyse various peaceful annexations to France from the Middle Age to 1860, in highlighting their different historical contexts and characteristics. These annexations occurred peacefully, but the process did involve tensions or debates, both during and after the annexations.
