In Minorities, their Rights, and the Monitoring the European Framework Convention for the Protection of National Minorities , Malloy and Caruso have collected a number of essays authored by prominent European experts on minority rights with aim to provide a first ever description and analysis of the processes guiding the monitoring of the Convention. The volume addresses both the technical and political side of the monitoring, and it brings in not only views from the host of the Convention, the Council of Europe, but also from the external players that interact with the Convention in the course of seeking to protect Europe’s national minorities

The Framework Convention for the Protection of National Minorities: A Commentary, edited by Rainer Hofmann, Tove H. Malloy and Detlev Rein,presents an updated article-by-article assessment of the monitoring of theConvention's implementation. The Convention was opened for signature in1995 and entered into force on 1 February 1998. Within a very short period oftime, it was ratified by 39 Council of Europe member states, and it constitutesthe first (and only) international treaty establishing legally bindingobligations concerning the rights of persons belonging to national minorities.In this volume, the monitoring of the Convention is assessed by eminentexperts in the field of minority protection. They survey the scope ofapplication as interpreted by the Advisory Committee during the first fourcycles of monitoring by analyzing its approach and offering their individualassessments of potential improvements. The volume thus updates andaugments previous assessments.

Le programme de ces deux tables rondes mis en place conjointement par le Centre d’études européennes de l’Université de Szeged et le Centre d’études européennes de l’Université Jean Moulin Lyon III a abordé la question délicate du droit des minorités, et plus particulièrement le cas des minorités en Europe occidentale et centrale, ainsi que dans les pays méditerranéens. Durant ces deux journées, les débats se sont surtout portés sur l’analyse de la problématique générale de la protection des minorités par le droit international et européen, puis par les États membres. Ensuite, le débat s’est axé sur le statut des minorités ainsi que l’exercice des libertés religieuses dans les pays méditerranéens. Cette table ronde a réuni des experts en droit des minorités, universitaires, juges constitutionnels hongrois, membres du Parlement hongrois, et professeurs venus spécialement des pays méditerranéens pour cette occasion. L’objectif était d’échanger les opinions ainsi que de soulever les problèmes juridiques relevant du droit des minorités. C’était d’ailleurs une occasion de comparer les différentes approches adoptées par les conférenciers et participants de divers pays européens et pays méditerranéens

Depuis plusieurs années, les groupes de sociétés sont devenus des acteurs incontournables du paysage économique. En centralisant, par des moyens plus ou moins sophistiqués, le contrôle de sociétés distinctes, le groupe constitue une technique efficace pour réaliser des objectifs économiques variés: économies d’échelle, rationalisation des activités, injection de capital sans dilution du pouvoir, amélioration de l’allocation des ressources, etc. Nonobstant les atouts de ce dispositif, le groupe produit des effets juridiques qui sont susceptibles d’affecter peu ou prou les droits des parties prenantes ou des tiers. En raison du pouvoir d’injonction reconnu à la société mère sur ses filiales, il advient, en effet, souvent qu’une société doive supporter une charge (abandon de créance, prêt sans intérêts, etc.) dans l’intérêt du groupe. Or, il n’existe, à ce jour, aucune réglementation globale et cohérente permettant de réguler ce phénomène. Sous réserve de quelques mesures sporadiques, le droit belge des sociétés ne confère aucune expression juridique aux groupes. Le présent ouvrage a pour objet de mettre en évidence les situations où la protection des actionnaires minoritaires, des créanciers ainsi que des travailleurs – qu’ils soient liés à la société mère ou à la filiale – peut être compromise, de jauger de la capacité de la réglementation actuelle à faire minimalement droit à la protection de ces intérêts catégoriels et de s’interroger sur l’opportunité d’autoriser, dans certaines circonstances, la corrosion de la personnalité juridique. L’auteur expose ainsi de manière critique le droit applicable aux groupes de sociétés en Belgique et identifie les problèmes qui en découlent tout en esquissant des pistes de solution.
