Vor allem bei familiären Konflikten besteht die Gefahr, dass lange, kontradiktorische Gerichtsprozesse zu einer finanziellen und emotionalen Zerreißprobe für die Beteiligten werden. Daher gewinnen alternative Konfliktbeilegungsmethoden auch in der Familienrechtspraxis stetig an Bedeutung. Vor diesem Hintergrund ergründet die Verfasserin die aktuellen rechtlichen Rahmenbedingungen für eine schiedsgerichtliche Beilegung familienrechtlicher Streitigkeiten im deutschen und englischen Recht und deren Bedeutung in der Praxis. Neben einer eingehenden Analyse der derzeitigen Rechtslage fußt die rechtsvergleichende Untersuchung auf Erkenntnissen aus einer unter englischen und deutschen Familienrechtsanwälten durchgeführten Online-Umfrage sowie aus Interviews mit Familienschiedsrichtern.

Ranging widely across Western Europe, including the Upper and Lower Rhine regions, England, Italy, Catalonia, and Castile, this study explores the stark discrepancies in practice between the North of Europe and the South. Wolfgang P. Müller draws attention to the existence of public penitential proceedings in the North and their absence in the South, and explains the difference in demand, as well as highlighting variations in how individuals obtained written documentation of their marital status. This is a study of marriage litigation (with some reference to sexual offenses) in the archiepiscopal court of York (1300-1500) and the episcopal courts of Ely (1374-1381), Paris (1384-1387), Cambrai (1438-1453), and Brussels (1448-1459). All these courts were, for the most part, correctly applying the late medieval canon law of marriage, but statistical analysis of the cases and results confirms that there were substantial differences both in the types of cases the courts heard and the results they reached. Marriages in England in the later middle ages were often under the control of the parties to the marriage, whereas those in northern France and southern Netherlands were often under the control of the parties' families and social superiors. Within this broad generalization the book brings to light patterns of late medieval men and women manipulating each other and the courts to produce extraordinarily varied results.

A jour de l'ultime réforme en vue de la modernisation de la famille intervenue en 2015 et achevée le 23 février 2016, mais également de la loi n° 2016-297 du 14 mars 2016 relative à la protection de l'enfant, l'ouvrage offre des réponses aux questions soulevées par des situations familiales complexes, en particulier celles comportant un élément d'extranéité supposant l'application de la règle dans une superposition des ordres juridiques. Couples, filiation, autorité parentale, responsabilités en lien avec l'enfant, divorce, désunions, aliments, régimes matrimoniaux, successions, sont autant d'éléments soumis aux fluctuations de la vie affective des personnes et, de la mobilité croissante des individus. Les divers contentieux susceptibles de s'élever dans une famille souvent instable se règlent généralement devant les tribunaux, eux-mêmes de plus en plus spécialisés. Le législateur favorise cependant le recours à des modes alternatifs de résolution, en particulier la médiation : c'est là un des apports de cette deuxième édition.

« Mieux protéger les femmes » : telle est l’ambition de l’ordonnance de protection, créée en 2010. Ce dispositif doit permettre à la justice d’intervenir en urgence dans des situations de violence au sein des couples, sans qu’il soit nécessaire de porter plainte ou d’engager une procédure pénale. Pourtant, cet outil juridique demeure étonnement peu employé. Afin de comprendre pourquoi, cette enquête originale rend compte aussi bien de la fabrique de la loi que de sa mise en application. Croisant archives, entretiens, analyses statistiques et observation d’audiences, elle revient sur les conditions d’élaboration et de transformation de ce droit à la protection porté par les organisations féministes, avant d’analyser la manière dont les juges s’en sont emparés. Cette approche innovante permet de comprendre comment l’ordonnance de protection aboutit paradoxalement à instituer un seuil de violence « juridiquement acceptable » dans les couples, ce qui contribue à légitimer certaines pratiques d’extorsion du consentement féminin et perpétue ainsi la domination masculine.
