La littérature juridique ne cesse de concentrer son attention sur l'emprunteur, lequel est considéré comme étant tenu de l'unique ou la principale obligation qui dérive du contrat de prêt, à savoir l'obligation de restitution. Fort de ce constat, plusieurs auteurs entreprennent, depuis quelques années, de réhabiliter le prêteur en soulignant que le prêt d'une chose ne se réduit pas à sa restitution. Chemin faisant, ils parviennent à la conclusion que le prêteur est également tenu d'une obligation contractuelle : celle de procurer la jouissance temporaire d'une chose au profit de l'emprunteur. Désireux de parachever cette entreprise de réhabilitation du prêteur, il nous semble envisageable et éminemment souhaitable de cerner les contours exacts de l'obligation ainsi mise à la charge du prêteur. Pour ce faire, nous avons fait le choix de lui attribuer un nom – « obligation de prêter » – et de procéder en deux temps : tout d'abord, définir celle-ci afin d'en dévoiler la nature ; ensuite, mesurer celle-ci afin d'en révéler l'envergure.

Beginning in the twelfth century, Jewish moneylenders increasingly found themselves in the crosshairs of European authorities, who denounced the evils of usury as they expelled Jews from their lands. Yet Jews were not alone in supplying coin and credit to needy borrowers. Across much of Western Europe, foreign Christians likewise engaged in professional moneylending, and they too faced repeated threats of expulsion from the communities in which they settled. No Return examines how mass expulsion became a pervasive feature of European law and politics-with tragic consequences that have reverberated down to the present.Drawing on unpublished archival evidence ranging from fiscal ledgers and legal opinions to sermons and student notebooks, Rowan Dorin traces how an association between usury and expulsion entrenched itself in Latin Christendom from the twelfth century onward.
