Abstract

Trade in counterfeit and pirated goods is a vital threat for modern, innovation-driven economies, a worldwide phenomenon that grows in scope and magnitude. Counterfeiters ship infringing products via complex routes, with many intermediary points, which poses a substantial challenge to efficient enforcement. This study looks at the issue of the complex routes of trade in counterfeit pirated goods. Using a set of statistical filters, it identifies key producing economies and key transit points. The analysis is done for ten main sectors for which counterfeiting is the key threat. The results will facilitate tailoring policy responses to strengthen governance frameworks to tackle this risk, depending on the profile of a given economy that is known as a source of counterfeit goods in international trade.

These illegal products are frequently found in a range of industries, from luxury items (e.g. fashion apparel or deluxe watches), via intermediary products (such as machines, spare parts or chemicals) to consumer goods that have an impact on personal health and safety (such as pharmaceuticals, food and drink, medical equipment, or toys). This report assess the quantitative value, scope and trends of this illegal trade.

This methodology can be used in the future to refine the assessment as the quality and quantity of data improve. Ziel des Projekts zur Untersuchung von Ausmaß und Folgen der Produkt- und Markenpiraterie ist es, mehr konkrete Erkenntnisse zu gewinnen und das Bewusstsein dafür zu schärfen, wie groß das Problem ist. Welche Auswirkungen haben Verletzungen geistiger Eigentumsrechte auf Staat, Unternehmen und Verbraucher in OECD-Ländern wie auch Nicht-OECD-Volkswirtschaften?Im Rahmen dieser Studie wird eine rigorose Methodik entwickelt und angewendet, um die Inzidenz gefälschter und unerlaubt kopierter Produkte im Welthandel zu schätzen. Diese Methodik kann künftig dazu genutzt werden, die Untersuchung anhand qualitativ und quantitativ besserer Daten zu vertiefen. Die Studie liefert zudem eine Analyse des Markts für gefälschte und unerlaubt kopierte Produkte sowie der Effekte auf verschiedene hiervon betroffene Parteien, angefangen von den Inhabern geistiger Eigentumsrechte bis hin zu Verbrauchern und Staat. Ferner enthält sie eine Reihe detaillierter Momentaufnahmen unterschiedlicher Wirtschaftsbereiche, die aufzeigen, in welcher Art und Weise diese Sektoren von der Produkt- und Markenpiraterie betroffen sind und wie sie hierauf reagieren.

This study examines the potential for the misuse of small parcels for trade in counterfeit and pirated goods. It presents the legal and economic contexts of the operation of express and postal services. It also looks at the available data on volumes of small consignments, via postal and courier streams, in the context of seizures of counterfeit and pirated goods. Furthermore it analyses the links between the observed dynamics in markets for small parcels and the available information on misuse of this service by traffickers in counterfeit and pirated goods.
