Introduction : les dommages consécutifs aux thérapeutiques médicales sont une cause importante de morbidité et de mortalité dans le monde. Le nombre de réclamations, surtout dans le domaine orthopédique, contre les prestataires de soins ne cesse d’augmenter. Ces dommages engendrent des coûts importants au niveau du système de santé et de la sécurité sociale, mais aussi par le risque de pratique de « médecine défensive ». En Belgique, les patients victimes de dommages ou leurs ayants droits, peuvent introduire une demande d’indemnisation au Fonds des accidents médicaux (FAM). Cette étude a donc pour objectif d’analyser les demandes d’avis reçues au FAM. Matériels et méthodes : une étude rétrospective a été utilisée permettant l’analyse et la discussion des dossiers d’avis final du FAM reçues entre 2012 et 2015 dans le domaine orthopédique. Pour cela, nous avons considéré dans la mesure du possible les caractéristiques des patients, l’objet de leur demande, l’intervention utilisée et la région anatomique ayant subi le dommage. De plus, l’issue du dossier a permis de mettre en évidence une éventuelle responsabilité du prestataire de soins ou un accident médical non fautif. Ensuite, des chirurgiens orthopédiques et des anesthésistes ont été interrogés afin de réfléchir à des moyens de préventions pouvant être mis en place. Résultats et conclusions : notre étude révèle que ce sont les interventions chirurgicales au niveau des membres supérieurs (36%) qui sont les plus susceptibles de faire l’objet de déclarations d’accidents médicaux. 12% des dossiers ont abouti à la responsabilité d’un prestataire de soins, 3% à un accident médical sans responsabilité, et 20 % à un échec thérapeutique. La majorité des dossiers (65%) provenaient soit d’un dommage qui n’était pas lié (ou pas de manière certaine) à la prestation de soins de santé (24%), soit qui était considéré comme un risque connu (41%). En conclusion, il est essentiel d’améliorer la communication, le suivi et « la relation médecin-patient » vu cette tendance à l’augmentation des plaintes pour des complications ne provenant pas nécessairement d’erreurs médicales.
