Seit der Jahrtausendwende wird die etablierte wissenschaftliche Praxis durch die Idee von Open Science herausgefordert. Konkret geht es um fünf Formen einer veränderten wissenschaftlichen Praxis, die einen vereinfachten Zugang zu wissenschaftlicher Literatur (Open Access), wissenschaftlichen Daten (Open Data), Softwarecode (Open Source), forschungspraktischen Methoden (Open Methodology) sowie Begutachtungsprozessen (Open Peer Review) ermöglichen sollen. Nach mehr als zwei Jahrzehnten der Erprobung steht eine breite Umsetzung trotz enormer Erwartungen und wissenschaftspolitischer Förderprogramme noch aus. Durch umfassende Studien mit Open-Science-Preisträger:innen werden Motivstrukturen, Verständnisse, Persönlichkeitsfaktoren, Sozialisations- und Sensibilisierungsprozesse sowie Rahmenbedingungen im Kontext von Open-Science-Praktiken rekonstruiert, die für die Verankerung von zentraler Bedeutung sind. Die Ergebnisse offenbaren komplexe Motivationslagen bei Wissenschaftler:innen und die Vielschichtigkeit von Open Science in der konkreten Praxis. Dies bietet den Wissenschaftsorganisationen und der Wissenschaftspolitik neue Ansätze zur Förderung von Open Science.

At a time when the bill "for a digital Republic" proposes the insertion in the Code of research of provisions relating to open access, the National Center for Scientific Research (CNRS), alongside its partners in the ISTEX project as well as a large number of researchers and actors in the field of public research, offers this White Paper the fruit of its reflections and analyzes. For several years, the scientific community of public research has been advancing the need to create a legal and organizational framework for access to scientific and technical data and information in the digital world, in particular to data resulting from its own research activity. This White Paper reports on these reflections, on the practices of researchers in the use of scientific and technical information and digital tools.

For more than twenty years, the international research community has affirmed its support for open and collaborative practices that improve the quality, transparency, reproducibility and inclusiveness of science. In France, this orientation has been reflected in the adoption of two National Plans for Open Science, in 2018 and 2021. In this context and on the occasion of the French Presidency of the Council of the European Union, France organised the Open Science European Conference (OSEC) on 4 and 5 February 2022. This conference on the transformation of the research and innovation ecosystem in Europe was an opportunity to address in particular transparency in health research, the future of scientific publishing and the opening of codes and software produced in a scientific context, but also the necessary transformations of research assessment, summarised in the Paris Call presented during the event and calling for the creation of a coalition of actors committed to reforming the current system. This international event was organised was organised by the French Académie des sciences, the Ministry of Higher Education and Research, the French National Center for Scientific Research (CNRS), the National Institute of Health and Medical Research (Inserm), the High Council for Evaluation of Research and Higher Education (Hcéres), the National Research Agency (ANR), the University of Lorraine and the University of Nantes.

Digitisation enables open science. Digitisation has many aspects, in particular free access to scholarly publications and materials (Open Access), transparent review procedures (Open Peer Review) or open source technologies (Open Source). The programme Hamburg Open Science (duration 2018-2020) supports, among other things, cultural change in research. It is in this context that the present guide was created. It is intended to make the legal environment tangible. The guide first systematically elaborates the relevant areas of law. The second part answers legal questions about Open Science that come directly from universities and libraries. In this way, the guide is prepared and communicated in a practical manner. The authors of the guide are Dr. Till Kreutzer, partner at the law firm iRights.Law, and their research assistant Henning Lahmann. This second, completely revised and expanded edition was produced with the assistance of Dr. Ina Kaulen, Hamburg State and University Library Carl von Ossietzky.

Digitisation makes open science possible. This has many aspects, in particular free access to academic publications and materials (Open Access), transparent peer review procedures (Open Peer Review) or open source technologies (Open Source). Supporting open science in Hamburg as a research location is the aim of the framework Hamburg Open Science. The guidelines developed in this context are intended to make this ecosystem legally tangible. In the first part, the guidelines systematically develop the areas of law concerned. The second part answers legal questions on Open Science that come directly from universities and libraries. In this way, a practice-oriented preparation and mediation can be achieved. The authors of the guide are Dr. Till Kreutzer, partner of the law office iRights.Law, and Henning Lahmann, research associate at iRights.Law.
