Comme le rappelle le recteur Jean-Marie Carbasse, dans la préface du présent ouvrage, « qu'il s'agisse d'un droit naturel "classique", fondé sur l'ordre objectif du monde et donc en dernier ressort sur la loi divine, ou d'un droit naturel "moderne", fondé sur la seule nature humaine - au terme d'un processus de subjectivisation qui contenait en germe la prolifération désordonnée d'une multitude de "droits à..." -, les anciens juristes se sont toujours référés à un ordre normatif supérieur aux lois positives, même si sa définition et son contenu ont depuis longtemps suscité maints débats. » Ce sont ces débats théoriques, mais aussi leurs prolongements pratiques, qui ont fait l'objet des travaux des Journées internationales de la Société d'histoire du droit tenues à Grenoble et à Vizille en mai 2009.Les 21 contributions réunies dans ces actes illustrent la diversité des questions soulevées par la subordination du droit positif à des principes juridiques supérieurs et démontrent, s'il en était besoin, l'intérêt de l'approche historique de ces questions. Grâce à la participation d'historiens du droit français et étrangers (espagnols, italiens, polonais), mais aussi de spécialistes de science politique, de droit administratif et de droit international public, elles offrent des éclairages divers mais très complémentaires sur l'histoire et sur les aspects contemporains de la protection de la dignité humaine par le droit.

The early enlightenment has been seen as an epoch-making period in the development of modern Europe, marking the beginnings of the transition from a 'religious' to an essentially 'secular' understanding of human relations and generating in the process new accounts of the relationship between religion and politics, in which the idea of toleration figured centrally. In this volume of essays, leading scholars in the field challenge that view and explore the ways in which some of the most important discussions of toleration in the western tradition were shaped by understandings of natural theology and natural law. Far from representing a shift to non-religious ways of thinking about the world, the essays reveal the extent to which early enlightenment discussions of toleration presupposed a world-view in which God-given natural law established the boundaries between church and state and provided the primary point of reference for understanding claims to religious freedom.
