Abstract

Applying appropriate legal rules to companies with as much consistency and as little consternation as possible remains a challenge for legal systems. One area causing concern is the availability of damages for non-pecuniary loss to companies, a disquiet that is rooted in the very nature of such damages and of companies themselves. In this book, Vanessa Wilcox presents a detailed examination of the extent to which damages for non-pecuniary loss can be properly awarded to companies. The book focusses on the jurisprudence of the European Court of Human Rights and English law, with a chapter also dedicated to comparative treatment. While the law must be adaptable, Wilcox concludes that considerations of coherency, certainty and ultimately justice dictate that the resulting rules should conform to certain core legal principles. This book lays the foundation for further comparative research into this topic and will be of interest to both the tort law and broader legal community.

Abstract

Le dommage moral ne recouvre pas seulement les atteintes aux sentiments, en réalité la question de sa réparation interroge bien plus largement la protection accordée à l'ensemble des intérêts extrapatrimoniaux dans l'arbitrage. Malgré une large diffusion du droit à réparation du dommage moral, l'Incompréhension entourant ce chef de préjudice et sa réparation ont conduit certains tribunaux arbitraux à limiter ce droit à réparation. Au vu de ces développements et de l'importance croissante des droits fondamentaux dans les relations d'affaires internationales, il est devenu nécessaire de réaliser une revue complète de la question. Cette étude porte sur 368 sentences prononcées dans l'arbitrage d'investissement, l'arbitrage du commerce international et l'arbitrage du sport, dont 230 sentences inédites. L'histoire de la réparation de ce chef de préjudice étant rappelée, ces travaux proposent une étude empirique du dommage moral dans l'arbitrage. Les interrogations relatives à la compétence et aux pouvoirs des arbitres en relation avec ce chef de préjudice sont étudiées, de même que le droit à réparation du dommage moral et ses modalités. Enfin, l'étude aborde la question des remèdes disponibles (restitution en nature, indemnisation, satisfaction) et, en particulier, la fixation des indemnités versées pour le préjudice moral. Ces travaux montrent l'importance du droit à réparation du dommage moral et invitent à une approche plus cohérente de sa réparation.
