Abstract

This volume in the Brill Research Perspectives in Comparative Discrimination Law compares sex discrimination protection through three thematic lenses. Firstly, it charts and compares the evolution sex discrimination protection in human rights law in three treaty-bodies - the CEDAW Committee, the HRC and the CESCR. Second, it traces the development of sex discrimination protection in three domestic law frameworks - the United States, Australia and India. Finally, it compares the development of sex discrimination protection in international law with its development in the domestic laws of the three countries and analyses the implications of that comparison. Despite differences in the translation of international approaches to sex discrimination into domestic law and differences in social, political and cultural contexts, women appear to face similar limitations in accessing justice through sex discrimination frameworks.

Abstract

This volume conducts an in-depth analysis of the ECtHR's case law in the area of migration and asylum, exploring the role of the Court in this area of law. Each chapter deals with the case law on one specific ECHR article that is relevant for migrants, asylum seekers and refugees. In addition, the volume is enriched by two additional studies which deal with issues that are treated in a transversal manner, namely vulnerability and the margin of appreciation. The volume systematises the case law on aliens' rights under the ECHR, offering readers the chance to familiarise themselves with or gain deeper insight into the main principles the Strasbourg court applies in its case law regarding aliens.

Abstract

In The Political Potential of Upper Silesian Ethnoregionalist Movement: A Study in Ethnic Identity and Political Behaviours of Upper Silesians Anna Muś offers a study on the phenomenon of ethnoregionalism in one of the regions in Poland. Since 1945, ethnopolitics in Poland have been based on the so-called assumption of the ethnic homogeneity of the Polish nation. Even the transformation of the political system to a fully democratic one in 1989 did not truly change it. However, over the last three decades, we can observe growing discontent in Upper Silesia and the politicisation of Silesian ethnicity. This is happening in a region with its own history of autonomy and culturally diversified society, where an ethnoregionalist political movement appeared already in 1989.

Abstract

In The Crime of Genocide Then and Now; Evolution of a Crime, the editors Pavel Šturma and Milan Lipovský submit an analysis of the readiness of the definition of genocide to the world of 21st century. In this original and thought-provoking collection, the Editors provide a multilayered study of the "crime of crimes". Adopted in 1948, and based on Raphael Lemkin's idea, the definition of genocide belongs to the cornerstones of international criminal law and justice. This volume focuses on, among other topics, the narrow scope of protected groups, wider domestic adaptations of the definition, denial of genocide, and current legal proceedings related to the crime in front of the ICJ and ICC. In this way its authors, based primarily in Central and Eastern Europe, analyse and discuss the readiness of the definition to meet the challenges of criminal justice in our changing world.
