Abstract

Religious institutions, such as churches, are founded on organizational structures, constitute distinct entities in human society, and in their capacity as juristic persons are the repositories of rights and obligations. In certain jurisdictions the rights vested in a religious institution include constitutionally protected entitlements, such as the right to privacy, freedom of religion and belief, freedom of expression, freedom of association, and property rights. Religious communities, comprising persons sharing a particular confession of faith, lack an organized structure, do not qualify for legal subjectivity, and can therefore not participate in legal relationships as a distinct juristic entity. Rights associated with a religious community belong to the individual members of the community and can be exercised by those members, either individually or jointly with other members of the group. In international law, religious communities qualify as peoples for purposes of the right to self-determination. The rights belonging to religious institutions and religious communities to a large extent fall within the general enclave of economic, social and cultural rights. Economic and social rights have been singled out as a distinct category of constitutionally protected human rights in the early twentieth century and ultimately find their base in the encyclical Rerum Novarum (1891) of Pope Leo XIII. The Leuven Lectures, focused upon the above, seek to uncover the protection of the rights of religious institutions and religious communities in international law and in the constitutions of a cross-section of the international community of states.

Abstract

The 2005 UNESCO Convention on Cultural Diversity is a landmark agreement in modern international law of culture. It reflects the diverse and pluralist understanding of culture, as well as its growing commercial dimension. Thirty diplomats, practitioners and academics explain and assess this important agreement in a commentary style. Article by article, the evolution, concepts, contents and implications of the Convention are analysed in depth and are complemented by valuable recommendations for implementation. Abstract

Le programme de ces deux tables rondes mis en place conjointement par le Centre d’études européennes de l’Université de Szeged et le Centre d’études européennes de l’Université Jean Moulin Lyon III a abordé la question délicate du droit des minorités, et plus particulièrement le cas des minorités en Europe occidentale et centrale, ainsi que dans les pays méditerranéens. Durant ces deux journées, les débats se sont surtout portés sur l’analyse de la problématique générale de la protection des minorités par le droit international et européen, puis par les États membres. Ensuite, le débat s’est axé sur le statut des minorités ainsi que l’exercice des libertés religieuses dans les pays méditerranéens. Cette table ronde a réuni des experts en droit des minorités, universitaires, juges constitutionnels hongrois, membres du Parlement hongrois, et professeurs venus spécialement des pays méditerranéens pour cette occasion. L’objectif était d’échanger les opinions ainsi que de soulever les problèmes juridiques relevant du droit des minorités. C’était d’ailleurs une occasion de comparer les différentes approches adoptées par les conférenciers et participants de divers pays européens et pays méditerranéens
