Abstract

"From ancient to modern times, sexualised war violence against women was tolerated if not encouraged as a means of reward, propaganda, humiliation, and terror. This was and is in defiance of international laws that have criminalised acts of sexualised war violence since the 18th century. Ad hoc international tribunals have addressed especially war rape since the 15th century. The International Criminal Court (ICC), however, is the first independent, permanent, international criminal court that recognises not only war rape but also sexual slavery and other sexualised crimes as crimes against humanity, war crimes, and acts of genocide in its statute and supporting documents. This book explores how the ICC definitions of rape and forced marriage came about, and addresses the ongoing challenge of how to define war rape and forced marriage in times of armed conflict in a way that adequately reflects women's experiences, as well as the nature of the crimes. In addition to deepening the understanding of the ICC negotiations of war rape and forced marriage, and of the crimes themselves, this volume highlights relevant factors that need to be considered when criminalising acts of sexualised war violence under international law. Sexualised Crimes, Armed Conflict and the Law draws on feminist and constructivist theories and offers a comprehensive theoretical and empirical examination of the definition of rape and forced marriage. Abstract

This book examines the traffic in women for Marriage, a phenomenon that has been largely overlooked in international efforts to address to the problem of human trafficking. In contrast to current international and state-based approaches to trafficking - which tend to focus on sex trafficking and trafficking for forced labour - this book seeks to establish how Marriage, as an institution, is often implicated in the occurrence of trafficking in women. Through the use of case studies on forced Marriage, mail-order bride (MOB) Marriage, and Fundamentalist Mormon polygamy, the book demonstrates that certain kinds of Marriage may in fact constitute situations of trafficking in persons, and together form an under-recognised phenomenon of 'Marriage trafficking'. Additionally, the book offers a new perspective on the types of harm involved in trafficking in women by developing a framework for identifying the particular abuses characteristic to Marriage trafficking. It argues that the traffic in women for Marriage cannot be understood merely as a subset of sex trafficking or trafficking for forced labour but constitutes a distinctive form of trafficking in its own right. The book aims firstly to establish why Marriage has tended to not be included in dominant conceptions of trafficking in persons, particularly at the level of international and state-based policy and legislation. The second aim is to determine whether certain types of Marriage may constitute cases of human trafficking, in and of themselves, thereby pointing to a broader problem of 'Marriage trafficking'. It will be of great interest to scholars and postgraduates working in the fields of human rights theory and institutions, political science, international law, transnational crime, trafficking in persons, and feminist political theory.

"Many of the themes of Aeschylus' Suppliants - the treatment of refugees, forced marriage, ethnic and cultural clashes, decisions on war and peace, political deception - resonate strongly in the world of today. The play was, however, for many years neglected in comparison to Aeschylus' other works, probably in part because it was wrongly believed to be very early and hence 'primitive', and this edition, aimed primarily at advanced undergraduates and graduate students, is the first since 1889 to offer an accessible English commentary based on the Greek text. This provides particular help with the peculiarities of tragic, especially Aeschylean, Greek. An extensive introduction discusses the Danaid myth and its many variations, the four-play production (tetralogy) of which Suppliants formed part, the underlying social and religious issues and presuppositions, the conditions of performance, and the place of Suppliants in Aeschylus' work, among other topics"--

In sub-Saharan Africa, the relationship between coercion and consent in marriage is a complex one that varies over time and place, rendering impossible any single interpretation or explanation. The legal experts, anthropologists, historians, and practitioners contributing to Marriage by Force? focus on the role that marriage plays in labor mobilization, wealth accumulation, and domination versus dependency. Abstract

Le phénomène des mariages forcés recouvre l'ensemble des situations dans lesquelles un individu, mineur ou majeur, est contraint de former une union civile ou religieuse sans son libre et plein consentement. Cette pratique résulte le plus souvent de contraintes sociales ou familiales associées à des convictions religieuses ou culturelles.Des règles spécifiques ont été développées afin d'endiguer ce phénomène. Outre les instruments internationaux de protection des droits de l'homme qui énoncent que le mariage ne peut être conclu qu'avec le libre et plein consentement des futurs époux, des législations nationales tentent d'encadrer cette pratique, notamment en modifiant l'âge légal minimum du mariage ou en établissant des sanctions pénales contre ceux qui planifient ou célèbrent l'union. L'élaboration d'un cadre juridique efficace aux échelles régionale et internationale est cependant rendue difficile par la disparité des législations.Le présent ouvrage approfondit les réflexions menées lors de plusieurs conférences organisées par l'IRDEIC (Université Toulouse 1 Capitole). Les contributions qui y sont réunies, issues des analyses d'universitaires et de praticiens, abordent les problématiques juridiques engendrées par les mariages forcés et les pratiques qui y sont associées.

Abstract

This collected edition by experts from all over the world, reflects a multidisciplinary approach to marital captivity and shows a multifaceted view of this widespread phenomenon. Marital captivity is a social and human rights problem that occurs within religions or religious communities worldwide. It is defined as a situation in which one or both spouses, but predominantly the wife, is unable to terminate a religious marriage, consequently trapping that spouse within the marriage against her or his will. As such it is a form of forced marriage and violence against women. Because of its severe social, legal, and economic implications, the phenomenon is approached from different perspectives: anthropological, sociological and legal.
