Abstract

[3e éd.] Le livre porte sur le droit social de l’Union européenne. Il concerne le droit du travail et de la sécurité sociale élaboré par les institutions créées au sein de cet ensemble d’états. Il examine également le règlement des conflits de lois et de juridictions. Partout, les états se regroupent pour résister plus fermement à la dilution des pouvoirs nationaux. L'Europe offre, chacun le sait, la forme la plus sophistiquée d’entité supranationale. Le droit qui en procède a par conséquent un caractère précurseur, créatif et novateur ; le traité de Lisbonne, entré en vigueur le 1er décembre 2009, est venu consolider une évolution aujourd’hui cinquantenaire. Aucun juriste, européen ou non européen, ne peut ignorer cette discipline, encore moins s’il est juge, avocat, ou chercheur, responsable d’entreprise ou de syndicat. Une première partie rappelle le cadre institutionnel du droit social européen. Une deuxième traite, à ce niveau, des normes sociales fondamentales, en particulier de l’égalité entre les femmes et les hommes au travail et de leur libre circulation. La troisième regarde la promotion de l’emploi, la quatrième, le rapprochement des droits nationaux relatifs aux rapports tant individuels que collectifs. La dernière partie étudie la coordination européenne des droits nationaux du travail et de la sécurité sociale. Sur chacun des sujets de fond, l’auteur s’attache à relier les normes adoptées aux problématiques de politiques sociales que rencontrent les Autorités européennes comme les Gouvernements nationaux. Dans l’analyse de chacun de ces thèmes, une place importante est réservée à la jurisprudence de la Cour de Justice de l’Union européenne. L’ouvrage, dont la deuxième édition intègre les normes et la jurisprudence européennes les plus récentes, se termine par des réflexions sur le ou les modèles sociaux européens.

Abstract

The Natura 2000 network of protected areas is the centrepiece of European Union nature policy, currently covering almost one-fifth of the EU’s entire land territory plus large marine areas. This vast EU-wide network, which aims to conserve Europe’s most valuable and threatened species and habitats, has major impacts on land use throughout all Member States of the EU. This book critically assesses the origins and implementation of the Natura 2000 network, established under the Birds Directive of 1979 and the Habitats Directive of 1992.Based on original archival research and interviews with key participants, the book records a detailed history of the origins and negotiation of Natura 2000 policy and law, with the history of EU environmental policy provided as a framework. An historical institutionalist approach is adopted, which emphasises the importance of understanding legal and policy development as processes that unfold over time. Three phases in the history of EU environmental policy are identified and described, and the history of EU nature policy is placed within the context of these three phases. Informed by this history, the author presents a comprehensive summary and assessment of the law and policy that protects Natura 2000 sites at EU level, and reviews the nature conservation outcomes for the targeted species and habitats. The book reveals how a knowledge of the history of Natura 2000 enriches our understanding of key issues such as conflicts in establishing and conserving the Natura 2000 network, EU integration in the field of nature conservation, and the future of EU nature policy.

Abstract

European capital markets law has developed rapidly in recent years. Abstract
