La fin de la prohibition des drogues est-elle pour demain ? Dans 10 ans ? Peu importe, en un sens. Après tout, on ne se demande pas s'il vaut la peine de lutter contre le racisme ou la pollution. C'est un choix de société. Il en va de même dans le cas de la prohibition des drogues, dont il est pressant de sortir. Bien sûr, la légalisation ne fera pas disparaître les problèmes liés aux usages problématiques des drogues. L'enjeu prioritaire est plutôt de favoriser les conditions d'une prévention adéquate et des stratégies d'aide appropriées, et ce, tant au plan individuel que collectif. De même, la légalisation ne mettra pas fin à la criminalité internationale qui gravite autour de ces marchés. De nombreuses autres activités criminelles produisent des revenus illégaux : le blanchiment d'argent, le trafic d'armes, de déchets dangereux ou d'organes, la traite des êtres humains, etc. Mais la légalisation éliminera une grande partie de la criminalité liée à la distribution locale et à l'approvisionnement des drogues, améliorant la qualité de vie des citoyens.

The subject of the dissertation is church asylum under the 2015 agreement of the Federal Office for Migration and Refugees (BAMF) and the Christian churches. The main legal, as well as actual differences to the granting of church asylum since the end of the 1980s are elaborated. The effects of the BAMF-church agreement and the subsequently implemented dossier procedure on the "legal problems" of church asylum are analyzed. This makes it possible to answer whether a legalization of church asylum - already feared 30 years ago - has occurred. In the result no legalization can be recognized, but a so far unknown degree of formalization. The state-provided hardship procedure for refugees in church asylum restricts the legitimacy of any sanctions or eliminates them altogether and shifts the burden of justification in other ways as well. This leads to new or changed consequences of church asylum under simple law.
