Handbook of Trial Consulting Richard L. Wiener and Brian H. Bornstein, editors Since its beginnings in scientific jury selection, trial consulting has engendered a growing academic literature, a professional association, and a thriving industry covering many discrete areas of practice. And while there is no specific course of study for trial consultants, much of what constitutes the field falls under the heading of legal psychology, with a number of available volumes on the subject. The Handbook of Trial Consulting differs from the others in its emphasis on social analytic jurisprudence, an empirically-based interdisciplinary lens for understanding legal issues and testing the assumptions that the law, and lawyers, make about human behavior, helping to ensure impartial, efficient service in diverse contexts while minimizing procedural and ethical pitfalls. Contributors focus on applied research methods, effective testimony strategies, specific psycholegal issues, and professional concerns to examine what trial consultants should know about: Jury selection and jury decision-making Social-cognitive aspects of legal persuasion The admissibility of expert witness testimony. Using survey research, statistics, and technological evidence Assessment of monetary and neuropsychological damages Avoiding conflicts of interest Occupying a crucial intersection between disciplines (and even advising legal professionals about what they can expect from consultants), the Handbook of Trial Consulting is a field-defining resource for legal psychologists, andpsychiatrists, lawyers, criminologists, sociologists, and political scientists as well as graduate students and academicians in psychology and law. .

Two things are certain in the contemporary workplace: the aging of employees, and negative attitudes toward them—especially those with disabilities—by younger colleagues and supervisors. Yet related phenomena seem less clear: how do negative stereotypes contribute to discrimination on the job? And how are these stereotypes perceived in legal proceedings? Bringing theoretical organization to an often unfocused literature, Disability and Aging Discrimination offers research in these areas at the same level of rigor as research into racial and gender discrimination. The book applies Social Analytic Jurisprudence, a framework for testing legal assumptions regarding behavior, and identifies controversies and knowledge gaps in age-discrimination and disability law. Chapters provide historical background or present-day context for the prevalence of age and disability prejudices, and shed light on the psychosocial concepts that must be understood, in addition to medical considerations, to make improvements in legal standards and workplace policy. Among the topics covered: • Applying Social Analytic Jurisprudence to age and disability discrimination. • The psychological origins and social pervasiveness of ageism. • Growing older, working more: the boomer generation on the job. • Limitations of the Americans with Disabilities Act. • Disability and procedural fairness in the workplace. • Cross-cultural perspectives on stigma. The first volume of its kind, Disability and Aging Discrimination is essential reading for researchers, forensic and rehabilitation psychologists/psychiatrists, and those involved in the well-being of older and disabled workers.

Justice—a word of great simplicity and almost frightening scope. When we were invited to edit a volume on justice in law, we joked about the small topic we had been assigned. Often humor masks fear, and this was certainly one of those times. Throughout the project, we found daunting the task of covering even a fraction of the topics that usually fall under the umbrella of justice research in law. Ultimately, the organization of the book emerged from the writing of it. Our introductory chapter provides a road map to how the topics weave together, but as is so often the case it was written last, not ?rst. It was only when we had chapters in hand that we began to see how the many strands of justice research might be woven together. Chapters 2–4 on the basic forms of justice—procedural, retributive, and distributive—are the lynchpin of the volume; they provide the building blocks that permit us to think and write about each of the other substantive and applied chapters in terms of how they relate to the fundamental forms of justice. In the large central section of the volume (Chapters 5–9), the contributors address many ways in which the justice dimensions relate to one another. Most important for law is the relationship of perceptions of procedural justice and the two types of substantive justice—retributive and distributive.

This in-depth investigation of community sentiment examines why and how community sentiment is studied, how it may change or be changed, and its reciprocal relationship with laws and policy. Laws affecting children and the family, for instance actual and proposed laws regarding marriage and divorce, campus safety, sex offender registration are used to discuss the study of community sentiment. Yet, the book is broad enough to inform readers about sentiment toward issues beyond the law. The book also considers the relationships between community sentiment and individual attitudes, media, perceptions about justice, and negative legal, personal, and societal outcomes. This range of carefully chosen chapters condenses a broad knowledge base into a manageable and highly useful “go to” book about the study of community sentiment toward any topic. Among the topics covered: The reciprocal relationship between media, community sentiment and policy. Various measures and methodology used in gauging community sentiment toward law and other topics. Factors that influence or change sentiment. Relationships between attitude theory and community sentiment. Links between community sentiment and perceptions of justice. Unintended consequences of policy responses. Can community sentiment lead to ineffective laws? The Handbook of Community Sentiment is an expansive resource of interest to a variety of practitioners and researchers—psychologists, sociologists, criminal justice professionals and criminologists, and political scientists--as well as students in these and related fields.

This anthology highlights the theoretical foundations as well as the various applications of Behavioural Law and Economics in European legal culture. By the same token, it fosters the dialogue between European and American Law and Economics scholars. The traditional neo-classical microeconomic theory explains human behaviour by using Rational Choice. According to this model, people tend to maximize the difference between expected utility and cost (“expected utility theory”). This theory includes three assumptions: (1) unbounded rationality, (2) unbounded self-interest, and (3) unbounded willpower. Behavioural Economics questions these assumptions and endeavours to render economic analysis more realistic by underpinning it with psychological insights. In recent years, the influence of Behavioural Economics on the Economic Analysis of Law has gained momentum. Behavioural Law and Economics generates a better theoretical understanding of legal phenomena and offers a multitude of applications in legislation and legal adjudication. This volume is testament to the growing and thriving Law and Economics movement in Europe. The European Law and Economics community has steadily grown and the yearly Law and Economics Conference at the law faculty of the University of Lucerne has successfully become a guiding star in the vast sky of Law and Economics.

Psychological data have now become central in many areas of legal practice including criminal, health care, and child custody domains. Unfortunately, the professional and empirical literature has not kept pace with this proliferation. Forensic Psychology: From Classroom to Courtroom fills this void, synthesizing the contributing authors' expertise into a versatile, authoritative, and empirically-derived delineation of the current status of psychological practice in each topic area, relative strengths and weaknesses of current behavioral evidence of forming legal/forensic opinions, and recommendations for future work. The book includes a discussion of the propagation of forensic psychology as a field of specialization, professional preparation issues for training as a forensic psychologist, unique ethical concerns, and an authoritative discussion of issues in several prominent areas of forensic psychology practice.

Stalking and Violence: New Patterns of Obsession and Trauma provides new perspectives on the prevalence, causes, and effects of stalking in intimate and non-intimate relations. Drawing on the results of a large random survey of restraining orders, this book found that stalking is highly prevalent in a variety of relationships and is a pattern of behaviors that is routinely regulated by the demographic and social characteristics of the victims and offenders. This book demonstrates that it is possible to develop reliable stalker profiles to help better detect and respond to the threat of stalking. These findings differ from previous studies that considered stalking limited to severely disturbed persons. Covering a wide range of topics from offender profiling, the dangers of stalking, cyberstalking, traumatic health effects, and the responses of the police and courts to stalking, this book will be relevant to a wide range of professionals and students in the fields of mental health, criminal justice, law, social work, medicine, nursing, public health, security/safety, and internet technology.
