Longtemps restées, pour l’essentiel, l’apanage des historiens du droit et des chartistes, les archives judiciaires suscitent désormais un intérêt bien au-delà de ces cercles spécialisés, en particulier chez les historiens en quête de nouveaux objets. Et d’Europe les travaux s’étendent désormais aussi aux colonies et aux protectorats, dont les archives sont progressivement accessibles. La présente étude sur La justice française et le droit pendant le protectorat en Tunisie s’inscrit dans ce mouvement de recherche global et particulier. Le système judiciaire du protectorat de la France en Tunisie (1883-1956) est ici étudié dans son ensemble, tant en ce qui concerne ses acteurs (statuts des magistrats) que le fonctionnement des institutions (hiérarchie des ordres judiciaires et contrôle). Les contributions des différents auteurs montrent comment la Tunisie a pu servir de laboratoire d’expérimentation, les autorités ayant instauré ce protectorat de manière empirique. Les auteurs s’interrogent également sur l’exportation vers d’autres pays, voire vers la Franc, de certaines solutions pragmatiquement dégagées à partir du cas tunisien.
