The concept of juridification refers to a diverse set of processes involving shifts towards more detailed legal regulation, regulations of new areas, and conflicts and problems increasingly being framed in legal and rights-oriented terms. While law and development discourse has dealt with international poverty, advocates of poverty reduction usually operate within a nation-state context. This book provides a new framework for the future theoretical development of international poverty law. It also explores specific human rights initiatives that address particular aspects of poverty, including human rights conventions, measures to counter the tendency of intellectual property law to undermine food security, the right to food as framed in UN development documents, and the startlingly important development in South Africa of an alternative vision of constitutional law. The contributors position international poverty law as a legitimate field for multidisciplinary research and dialogue, and open up new arenas for international poverty law to contribute to addressing poverty reduction. This book provides a new framework for the future theoretical development of international poverty law. In Juridification of Religion? Helge Årsheim and Pamela Slotte explore the extent to which developments currently taking place at the interface between law and religion in domestic, regional and international law can be conceptualized as instances of larger, multidimensional processes of juridification. The book relies on an expansive notion of juridification , departing from the narrower sense of juridification as the gradually increasing “colonization of the lifeworld” proposed by Jürgen Habermas in his Theory of Communicative Action (1987). More specifically, the book adapts the multidimensional notion of juridification outlined by Anders Molander and Lars Christian Blichner (2008), developing it into a more context-specific notion of juridification that is attendant to the specific nature of religion as a subject matter for law.
