The essays in this volume in honour of Paul Brand, Senior Research Fellow of All Souls College, Oxford, match his career and interests in the world of legal history as well as medieval social and economic history and textual studies. The topics explored include the Angevin reforms, legal literature, the legal profession and judiciary, land law, the relation between the crown and the Jews, the interaction of the Common Law with Canon and Civil Law, as well as procedural and testamentary procedures, the management of both ecclesiastical and lay estates and the afterlife of medieval learning. Like Brand’s own work, all the essays are grounded on detailed studies of primary sources. The result is a high quality scholarly book that will be of interest and use to medieval scholars, students and non-specialists with wide-ranging and varied interests. The prize, which is awarded annually, is for the best article on English legal history published in the previous year. Au Moyen Âge, l’enquête est partout et de nombreux travaux en ont déjà éclairé les formes, les moyens et les enjeux. Ce colloque a pour originalité de proposer une réflexion d’ensemble, nourrie de comparaisons entre le Royaume de France et l’Italie, attentive à l’évolution chronologique depuis les inquisitiones carolingiennes jusqu’aux vastes investigations de la fin du Moyen Âge, et sensible aux variations des techniques mises en œuvre. En s’appuyant sur une documentation concrète que l’enquête a largement contribué à générer, chaque contribution met l’accent sur le temps et l’espace, sur les acteurs, enquêteurs ou témoins, sur les modalités de la décision et de la réception. L’enquête se lit alors comme un mode de gouvernement, comme un élément constitutif du regimen qu’elle peut contribuer à informer, à réparer et à réformer. Ainsi se précisent, au-delà du domaine judiciaire, les liens complexes que l’enquête entretient avec la vérité.

Based on legislation and legal practice from the period c. 1250-1600 the book takes issue with the most important viewpoints in earlier research by early modernists: that the Reformation represented a watershed in a development characterized by greater criminalisation of sexual acts, increase in the severity of sentences and deterioration of the position of women. According to this study, in principle all or mostly all factors were already in place in the Middle Ages. In Norwegian historiography the period investigated is characterized by paucity of sources, and the period has tended to fall between two stools, respectively the medievalist and the early modernist. The ambition of this book has been to bridge the gap.

Justicia est anima civitatis : les vingt-deux contributions rassemblées ici tentent de rendre aux villes une composante fondamentale de leur identité, l’exercice de la justice, tel qu’elles le revendiquent dès que le droit urbain prend corps à partir du XIIe siècle. De la Flandre à l’Italie du Nord et du Centre, la fameuse « Urban belt » de l’Europe ancienne a constitué le champ privilégié de cette recherche pour laquelle les historiens et les historiens du droit ont échangé leurs points de vue. Entre 1200 et 1500, des évolutions chronologiques parfois différenciées ont permis de cerner les transformations du droit écrit et le développement dynamique des nouvelles procédures. En favorisant le pénal, la question a été de comprendre quelles possibilités ont été offertes aux justiciables pour user de différents modes de résolution des conflits et comment les gouvernants des villes ont pu instituer des politiques judiciaires de type étatique. La justice est ainsi apparue comme un pan du lien politique et social des milieux urbains.

This monumental study of medieval law and sexual conduct explores the origin and develpment of the Christian church's sex law and the systems of belief upon which that law rested. Focusing on the Church's own legal system of canon law, James A. Brundage offers a comprehensive history of legal doctrines-covering the millennium from A.D. 500 to 1500-concerning a wide variety of sexual behavior, including marital sex, adultery, homosexuality, concubinage, prostitution, masturbation, and incest. His survey makes strikingly clear how the system of sexual control in a world we have half-forgotten has shaped the world in which we live today. The regulation of marriage and divorce as we know it today, together with the outlawing of bigamy and polygamy and the imposition of criminal sanctions on such activities as sodomy, fellatio, cunnilingus, and bestiality, are all based in large measure upon ideas and beliefs about sexual morality that became law in Christian Europe in the Middle Ages.
