Der Autor befasst sich mit der Behandlung des Grundstücksnießbrauchs in der Insolvenz. Nach einer Einführung in die zivilrechtlichen Grundlagen des entgeltlichen Nießbrauchs widmet sich der Autor den Folgen eines Insolvenzverfahrens für den Nießbrauch. Dabei geht er insbesondere auf die Fragen ein, wann dem Verwalter ein Wahlrecht nach § 103 InsO zusteht und ob die Vorschrift des § 108 InsO (analog) anzuwenden ist. Ferner beschäftigt sich das Buch mit der insolvenzrechtlichen Einordnung eines noch offenen Zahlungsanspruchs des Eigentümers in der Insolvenz des Nießbrauchers und wie sich der Grundstückseigentümer gegen einen Zahlungsausfall schuldrechtlich absichern kann. Abschließend wird der Sicherungsnießbrauch in der Insolvenz beleuchtet.

Depuis une dizaine d'années, le contexte politique de la recherche anthropologique en milieu amérindien a beaucoup changé. La nouvelle poussée capitaliste vers les ressources du Nord canadien a provoqué une réaction de défense de leurs droits territoriaux chez les autochtones habitant ces régions. La démonstration du bien-fondé et de la nature de ces droits dans le cadre des négociations avec les autorités fédérales et provinciales a suscité de nombreuses recherches portant en particulier sur l'occupation territoriale et l'exploitation des ressources fauniques. À la lumière d'une expérience d'anthropologie « impliquée », c'est-à-dire venant appuyer une démarche politique amérindienne, l'auteur conclut que l'anthropologue doit être plus conscient que par le passé des buts de sa recherche et de l'utilisation des résultats. In the last ten years the political context of anthropological research in Amerindian communities has changed greatly. Increased capitalist expansion toward the natural resources of the Canadian North has lead Native people living in these regions to defend their territorial rights. The legitimate rights of Native people and the nature of these rights in the framework of negociations with federal and provincial authorities have inspired numerous studies, particularly of territorial occupation and exploitation of animal resources. In the light of an experiment in "involved" anthropology which supports native policies, the author concludes that anthropologists should be more aware than they were in the past of the goals of their research and of the uses made of the results.
