Violence in Latin America and the Caribbean is no longer perpetrated primarily by states against their citizens, but by a variety of state and non-state actors struggling to control resources, territories, and populations. This book examines violence at the subnational level to illuminate how practices of violence are embedded within subnational configurations of space and clientelistic networks. In societies shaped by centuries of violence and exclusion, inequality and marginalization prevail at the same time that democratization and neoliberalism have decentralized power to regional and local levels, where democratic and authoritarian practices coexist. Within subnational arenas, unique configurations - of historical legacies, economic structures, identities, institutions, actors, and clientelistic networks - result in particular patterns of violence and vulnerability that are often strikingly different from what is portrayed by aggregate national-level statistics. The chapters of this book examine critical cases from across the region, drawing on new primary data collected in the field to analyze how a range of political actors and institutions shape people's lives and to connect structural and physical forms of violence.

"Since 1980, China has evolved from a poor and mostly rural society into one of the largest economies in the world. As it grew into a major industrial power, it demanded enormous amounts of steel for new factories and cities, copper for electronic wires, petroleum for cars and manufacturing plants, and soybeans and cattle to feed its workers. By the 1990s, many Latin American countries were riding China's coattails and beginning to prosper from the new demand. Ever since China entered the World Trade Organization at the turn of the century, Latin America supplied China with more and more of the primary commodities it needs and more. That in turn has produced one the most impressive periods of economic growth on the continent in fifty years. And it was more evenly spread too - a region infamous for its extreme inequality saw it decline by a couple of percentage points over the course of the era. In The China Triangle, Kevin P. Gallagher traces the development of the China-Latin America trade over time and covers how it has affected the centuries-old (and highly unequal) US-Latin American relationship. He argues that despite these opportunities Latin American nations have little to show for riding the coattails of the 'China Boom' and now face significant challenges in the next decades as China's economy slows down and shifts more toward consumption and services. While the Latin American region saw significant economic growth due to China's rise over the past decades, Latin Americans saved very little of the windfall profits it earned even as the region saw a significant hollowing of its industrial base. What is more, commodity-led growth during the China boom reignited social and environmental conflicts across the region. Scholars and reporters have covered the Chinese expansion into East Asia, Southeast Asia, Australasia, Africa, the US, and Europe. Yet China's penetration Latin America is as little understood as it is significant-especially for America given its longstanding ties to the region. Gallagher provides a clear overview of China's growing economic ties with Latin America and points to ways that Latin American nations, China, and even the United States can act in order to make the next decades of China-Latin America economic activity more prosperous for all involved"-- "Latin America rode the coattails of what may be seen as the most significant event of the 21 Century--the rise of China. As China grew from a poverty-stricken nation to the largest economy in the world, many Latin Americans boomed. Latin American countries sent iron ore to be forged into steel for China new cities; copper to lace China's boom electronics industry with wire; petroleum to fuel hundreds of millions of new cars. Indeed, from 2003 to 2013 Latin America experienced a China boom. Beginning in 2014 however, the boom began to fade, with China's economy slowing in general and shifting toward a consumer-based economy less dependent on natural resource imports. Latin America was caught over-exposed to China, and had saved very little of its China windfall to prepare for the future. The region now faces slow growth, and increasing social and environmental conflict. Drawing on ten years of research and traveling along the China-Latin America economic relationship, Gallagher tracks how the rise of China impacted Latin America, how Latin America squandered much of the benefits gained during its China boom, and how Latin Americans can better position themselves to turn growing Asian trade into prosperity"--

This book offers insights into how international investment law (IIL) has frustrated states’ protection of human rights in Latin America, and IIL has generally abstained from dealing with inter-regime frictions. In these circumstances, this study not only argues that IIL should be an object of contention and debate (‘politicisation’). It also contends that Latin American countries have traditionally been the frontrunners in the politicisation of international legal instruments protecting foreign investment, questioning whether the paradigms informing their claims’ articulation are adequate to frame this debate. It demonstrates that the so-called ‘right to regulate’ is the paradigm now prevalently used to challenge IIL, but that it is inadequate from a human rights perspective. Hence, the book calls for a re-politicisation of IIL in Latin America through a re-conceptualization of how states’ regulation of foreign investment is understood under international human rights law, which entails viewing it as an international duty. After determining what the ‘duty to regulate’ constitutes in relation to the right to water and indigenous peoples’ right to lands based on human rights doctrine, the book analyses the extent to which Latin American countries are currently re-politicising IIL through an articulation of this international duty, and arbitral tribunals’ responses to their argumentative strategies. Based on these findings, the book not only proposes investment treaties’ reform to anchor the ‘duty to regulate’ paradigm in IIL, and in the process, to induce tribunals’ engagement with human rights arguments when they come to underpin respondent states’ defences in investor-state dispute settlement (ISDS). In addition, drawing upon the (now likely defunct) idea of creating a regional ISDS tribunal, the book briefly reflects on options available to such a tribunal in terms of dealing with troubling normative/institutional interactions between regimes during ISDS proceedings.
