Abstract

This conference volume presents a multifaceted criminal law analysis of the concept of collectivisation, especially from the perspective of norm theory. First of all, the participation theory is taken up: Kindhäuser highlights problems of the collective commission of an offence by going to the semantic level of the discussion. Schneider looks at the international-criminal-law reference to participation. Bock deals with the concrete regulation in § 184j StGB. Subsequently, questions of attribution are addressed: Renzikowski discusses the possibility of considering collectives as subjects of imputation on the basis of legal philosophy. Wagner deals with the debate on the responsibility of principals. The volume is rounded off by two further aspects: Godinho highlights the relationship between collectivity and norm formation. Rösinger deals with the collectivisation of dangers and thus with aggressive necessity. Der vorliegende Tagungsband präsentiert eine vielseitige strafrechtliche Analyse des Kollektivierungsbegriffs insbesondere aus der Sicht der Normentheorie. Aufgegriffen wird zunächst die Beteiligungslehre: Kindhäuser stellt Probleme der gemeinschaftlichen Tatbegehung heraus, indem er sich auf die semantische Ebene der Diskussion begibt. Schneider betrachtet den international-strafrechtlichen Bezug der Beteiligung. Bock setzt sich mit der konkreten Regelung in § 184j StGB auseinander. Anschließend werden Zurechnungsfragen angesprochen: Renzikowski erörtert auf dem Boden der Rechtsphilosophie die Möglichkeit der Betrachtung von Kollektiven als Zurechnungssubjekte. Wagner beschäftigt sich mit der Debatte um die Geschäftsherrenverantwortlichkeit. Den Band runden zwei weitere Aspekte ab: Godinho hebt das Verhältnis von Kollektivität und Normgestaltung hervor. Rösinger geht auf die Kollektivierung von Gefahren und mithin auf den Aggressivnotstand ein.

Yet, due to the impact of personal, social, and cultural conditions on sexual interactions, defining the prerequisites of legally valid consent to sexual acts presents great challenges. This volume collects essays, national reports, and a comparative synopsis authored by experts from eleven jurisdictions. The broad spectrum of contributions provides policymakers and jurists interested in sexual crime with up-to-date information and legal argument. Elisa Hoven and Thomas Weigend are professors of criminal law at the universities of Leipzig and Cologne active in developing criminal policy.
