The study deals with the antitrust sanctions of the West African Economic and Monetary Union (Union Economique et Monétaire Ouest Africaine - UEMOA) and its member states, which was taken from EU law as a legal transplant. Differences to EU law are elaborated and, in particular, areas are identified in which UEMOA-specific problems require a different interpretation of sanctions law in the interest of effective protection of competition. In addition, the difficulties of implementation are highlighted and far-reaching and comprehensive measures are proposed, oriented towards European antitrust sanctions law, in order to achieve a more efficient prosecution of antitrust violations. Die Arbeit befasst sich mit dem Kartellsanktionenrecht der Westafrikanischen Wirtschafts- und Währungsunion (Union Economique et Monétaire Ouest Africaine – UEMOA) und ihrer Mitgliedstaaten, das dem EU-Recht als Rechtstransplantat entnommen wurde. Es werden Unterschiede zum EU-Recht herausgearbeitet und insbesondere Bereiche ausgemacht, in der UEMOA-spezifische Probleme eine abweichende Ausgestaltung des Sanktionenrechts im Interesse eines wirksamen Wettbewerbsschutzes erfordern. Außerdem werden die Schwierigkeiten bei der Implementierung aufgezeigt und tiefgreifende und umfassende Maßnahmen, unter Orientierung am europäischen Kartellsanktionenrecht, vorgeschlagen, um eine effizientere Verfolgung der Kartellrechtsverstöße zu erreichen.

The effective protection of the fundamental guarantee of Art. 3 ECHR requires clear minimum standards in the penitentiary system as well as their consistent enforcement. The core piece of the thesis consists of a comprehensive analysis of the minimum standards in the light of Art. 3 ECHR with a focus on overcrowding and health care in the penitentiary system as well as of a differentiated implementation study on the enforcement mechanisms – from preventive measures to the pilot judgment technique of the ECtHR and the monitoring by the Committee of Ministers. In particular, it provides an in-depth analysis of the decision-making practice of the ECtHR and the Swiss Federal Supreme Court and outlines which measures in which implementation phase and for which case groups can ensure effective enforcement. Der effektive Schutz der Fundamentalgarantie von Art. 3 EMRK setzt klare Mindeststandards im Strafvollzug sowie deren konsequente Durchsetzung voraus. Herzstücke der Arbeit sind die umfassende Analyse der Mindeststandards im Lichte des Art. 3 EMRK mit den Schwerpunkten Überbelegung und Gesundheitsversorgung im Strafvollzug und eine differenzierte Implementierungsstudie zu den Enforcement-Mechanismen – von vorsorglichen Massnahmen über die Piloturteilstechnik des EGMR bis zur Überwachung durch das Ministerkomitee. Dabei wird insbesondere die Tiefendimension der Spruchpraxis des EGMR und des Schweizerischen Bundesgerichts ergründet und dargelegt, welche Massnahmen in welcher Umsetzungsphase und für welche Fallgruppen für eine effektive Durchsetzung sorgen können.

This book examines the criminal liability for market manipulation pursuant to section 119 of the German Securities Trading Act (WpHG) under the European market abuse regime in force as of 2016. The changes in criminal liability brought about by European norms are analysed coherently. A legal comparison with EU countries reveals that the requirement of price impact is a special feature of the German offence. The book closely examines a new qualification of a crime, which raises unresolved questions as to its preconditions and has important consequences for criminal proceedings. Practising as a criminal defence lawyer, the author has a wealth of experience in capital markets criminal law and places particular emphasis on practical insights. Das Werk untersucht die Strafbarkeit der Marktmanipulation gem. § 119 WpHG unter dem ab 2016 geltenden europäischen Marktmissbrauchsregime. Die durch europäische Normen bewirkten Änderungen der Strafbarkeit werden zusammenhängend untersucht. Im Rechtsvergleich mit anderen EU-Ländern zeigt sich mit der Preiseinwirkung eine Besonderheit der deutschen Strafnorm. Im Detail untersucht das Buch die neue Verbrechensqualifikation (§ 119 Abs. 5 WpHG), die hinsichtlich ihrer Tatbestandsvoraussetzungen ungeklärte Zweifelsfragen aufwirft und strafprozessual bedeutende Folgen hat. Der als Strafverteidiger tätige Autor verfügt über langjährige Erfahrung im Kapitalmarktstrafrecht und legt besonderes Augenmerk auf die Erfahrungen der Praxis.
