Abstract

Ce travail a pour vocation de comprendre les implications et conséquences que la directive sur la distribution d’assurance, appelée « IDD », pourrait avoir sur l’environnement de l’assurance-vie luxembourgeoise. Pour ce faire, notre objectif est de répondre à la problématique suivante : comment la directive relative à la distribution d’assurance « IDD » impacte-t-elle le monde du courtage en assurance-vie au Grand-Duché de Luxembourg ? 

Dans une première partie, seront appréhendés les points essentiels à la compréhension du fonctionnement du contrat d’assurance-vie luxembourgeois. Puis, nous abordons l’utilité pour un investisseur ou un souscripteur de conclure un contrat d’assurance-vie spécialement au Luxembourg, c’est à dire au regard des aspects de sécurité du souscripteur, de gestion financière ainsi que des différentes stratégies d’investissement. Cette partie sert d’ancrage théorique pour permettre de comprendre les éléments de base du contrat d’assurance-vie luxembourgeois. 

Dans une seconde partie, nous nous attelons à l'examen de la directive ainsi qu’à l’étude empirique de ce travail. D’abord, il est question de faire brièvement un état des lieux concernant la directive « IDD » ainsi que son étendue. Notre étude empirique porte ensuite sur une analyse auprès des professionnels du secteur de l’assurance-vie au Luxembourg. Dans cette partie, nous tentons de déceler et de comprendre la manière dont la directive impacte les métiers de l’assurance-vie luxembourgeoise. Enfin, nous terminons cet exposé par une critique des résultats obtenus où nous formulons, à travers une discussion, les difficultés et limites rencontrées lors de la réalisation de ce travail et de l’étude.

Pour conclure, nous reprendrons les éléments essentiels de ce travail, les enseignements à retenir de notre étude empirique ainsi que les conséquences découlant de l’implémentation de la directive « IDD » dans le secteur de l’assurance-vie luxembourgeoise.

Abstract

This open access volume of the AIDA Europe Research Series on Insurance Law and Regulation offers the first comprehensive legal and regulatory analysis of the Insurance Distribution Directive (IDD). The IDD came into force on 1 October 2018 and regulates the distribution of insurance products in the EU. The book examines the main changes accompanying the IDD and analyses its impact on insurance distributors, i.e., insurance intermediaries and insurance undertakings, as well as the market. Drawing on interrelations between the rules of the Directive and other fields that are relevant to the distribution of insurance products, it explores various topics related to the interpretation of the IDD – e.g. the harmonization achieved under it; its role as a benchmark for national legislators; and its interplay with other regulations and sciences – while also providing an empirical analysis of the standardised pre-contractual information document. Accordingly, the book offers a wealth of valuable insights for academics, regulators, practitioners and students who are interested in issues concerning insurance distribution.
