Abstract

Ces dernières décennies ont vu éclore de nombreux mouvements militant pour une reconnaissance juridique internationale du crime d’écocide. Stop Ecocide International, End Ecocide on Earth ou encore End Ecocide Belgium n’en sont que quelques exemples. Ces organisations de la société civile jouent un rôle important dans le débat et la publicité autour de l’écocide. Mais tout d’abord, il convient de définir ce qu’est un écocide. Pour ce faire, de nombreux experts, tels que Polly Higgins, Laurent Neyret ou un panel d’expert co-présidé par Philippe Sands ont proposé différentes définitions. Les avis divergent et aucune définition n’est aujourd’hui reconnue dans le droit international. On peut aussi se poser la question des enjeux d’un amendement du Statut de Rome afin d’y inclure l’écocide. C’est sur ce thème que s’est portée la question de recherche de se mémoire. Afin d’y répondre, une revue de la littérature et des entretiens avec des acteurs du terrains ont été effectués. Il en est ressorti quatre enjeux principaux qui sont : l’importance de la définition, les conséquences dans les législations pénales nationales, le caractère dissuasif d’une criminalisation et enfin la responsabilité des personnes morales. Over the last few decades, many movements have emerged to advocate for an international legal recognition of the crime of ecocide. Stop Ecocide International, End Ecocide on Earth or End Ecocide Belgium are just a few examples. These civil society organizations play an important role in the debate and publicity of ecocide. But first, we need to define what ecocide is. To do so, many experts, such as Polly Higgins, Laurent Neyret or a panel of experts co-chaired by Philippe Sands have proposed different definitions. Opinions differ and no definition is currently recognized in international law. One can therefore also ask the question of the stakes of an amendment to include ecocide in the Rome Statute. This is what the research question of this thesis is about. In order to answer this question, a review of the literature and interviews with different actors were conducted. Four main issues emerged: the importance of the definition, the consequences in national criminal law, the dissuasive character of a criminalization and finally the responsibility of legal persons.

Abstract

Three distinct types of contractions perform colonic motility functions. Rhythmic phasic contractions (RPCs) cause slow net distal propulsion with extensive mixing/turning over. Infrequently occurring giant migrating contractions (GMCs) produce mass movements. Tonic contractions aid RPCs in their motor function. The spatiotemporal patterns of these contractions differ markedly. The amplitude and distance of propagation of a GMC are several-fold larger than those of an RPC. The enteric neurons and smooth muscle cells are the core regulators of all three types of contractions. The regulation of contractions by these mechanisms is modifiable by extrinsic factors: CNS, autonomic neurons, hormones, inflammatory mediators, and stress mediators. Only the GMCs produce descending inhibition, which accommodates the large bolus being propelled without increasing muscle tone. The strong compression of the colon wall generates afferent signals that are below nociceptive threshold in healthy subjects. However, these signals become nociceptive; if the amplitudes of GMCs increase, afferent nerves become hypersensitive, or descending inhibition is impaired. The GMCs also provide the force for rapid propulsion of feces and descending inhibition to relax the internal anal sphincter during defecation. The dysregulation of GMCs is a major factor in colonic motility disorders: irritable bowel syndrome (IBS), inflammatory bowel disease (IBD), and diverticular disease (DD). Frequent mass movements by GMCs cause diarrhea in diarrhea predominant IBS, IBD, and DD, while a decrease in the frequency of GMCs causes constipation. The GMCs generate the afferent signals for intermittent short-lived episodes of abdominal cramping in these disorders. Epigenetic dysregulation due to adverse events in early life is one of the major factors in generating the symptoms of IBS in adulthood.
