Abstract

With the continuing expansion of global economic integration, labor standards in developing countries have become a hot button issue. One result has been a proliferation of efforts to use the market to put pressure directly on multinational corporations to improve wages and working conditions in their overseas operations and to insist that their suppliers do so as well. This paper analyzes the dynamics of these efforts in terms of a 'market for standards' in which consumers, stimulated by human rights activists, demand that corporations improve working conditions in supplier factories. The paper presents evidence that such a consumer demand exists and analyzes the incentives corporations face to respond to it. It examines the nature of the critical intermediary role played by activists in stimulating consumer demands and assesses the outcomes in the major anti-sweatshop campaigns of the 1990s. The paper also addresses the limitations of such consumer-based campaigns and the concern expressed by some that these activist campaigns may do more harm than good, by deterring investment in and trade with poor countries. It concludes with an overall assessment of when 'doing good' actually does good.

Abstract

Während die 1990er Jahre als eine Hochzeit der internationalen Menschenrechtsbewegung galten, ist die Debatte über Menschenrechte seit einigen Jahren zunehmend von Skepsis und Pessimismus geprägt. Schlagworte wie "Endzeit" oder "Dämmerung" der Menschenrechte sollen signalisieren, dass mit dem Internationalen Recht auch die Menschenrechte in eine Legitimationskrise geraten sind. Teilweise speist sich die gegenwärtige Kritik aus tagespolitischen Entwicklungen, greift vielfach aber auch auf grundsätzlichere Argumente zurück. Diese haben die Auseinandersetzung über Gehalt und Geltungskraft der Menschenrechtsidee von Anfang an begleitet. Denn schon immer war die Genese moderner Menschenrechtskonzeptionen eng mit deren jeweiligen Gegenentwürfen verwoben. Dabei lassen sich pragmatische Kritik und grundsätzliche Gegnerschaft nur selten auseinanderhalten. Menschenrechtskritik entsprang vielschichtigen Motivlagen und trat zudem in unterschiedlichen Mischungsverhältnissen und Schattierungen auf. Dieser Befund fordert dazu heraus, das Phänomen der Menschenrechtskritik zu historisieren und zu systematisieren.

Abstract

The concept for more effective civic participation in support of four vulnerable groups aims to identify legislative changes, improvement of practices and policy development by decision makers and the civil society to facilitate vulnerable communities in their interaction with state institutions and establish effective support mechanisms. The publication proposes concrete solutions and a roadmap for their implementation for each of these groups - prisoners, victims of human trafficking, victims of domestic violence, asylum seekers and other vulnerable groups of foreigners.

"At a time when states are increasingly hostile to the international rights regime, human rights activists have turned to non-state and sub-state actors to begin the implementation of human rights law. "How can we make sense of human rights in China's authoritarian system? In this insightful book, China law expert Eva Pils offers a nuanced account of this contentious area, examining human rights as a set of social practices involving a variety of actors, including officials of the system and civil society actors. Drawing on a wide range of resources including years of interaction with Chinese human rights defenders, Pils discusses sources of human rights violations, as well as institutional avenues of protection and social practices of human rights defence. Three central areas are given special attention: liberty and integrity of the person and the right not to be tortured; freedom of thought and expression; and inequality and socio-economic rights. Pils argues that the Party-State system is inherently opposed to human rights principles in all these areas. Yet, civil society actors have developed social practices of human rights advocacy whose political significance is not entirely dependent on the Party-State. Despite authoritarianism's lengthening shadows, China's human rights movement has so far proved resourceful and resilient, and the trajectories discussed in this book will continue to shape ongoing struggles"--
