Abstract

Asia is the only area in the world that does not have a human rights court or commission covering the region as a whole. However, a close look at recent developments in the region, especially in East Asia, shows that a human rights system is emerging. Various activities and initiatives for human rights cooperation are developing in Asia at the regional, sub-regional and national levels. Since the establishment of the ASEAN human rights body (AICHR) in 2009, the need for a review of the regional human rights mechanisms in Asia is stronger than ever. With a primary focus on twenty-three East Asian states, Tae-Ung Baik highlights the significant changes that have taken place in recent decades and demonstrates that the constituent elements of a human rights system (norms, institutions and modes of implementation) are developing in Asia.

Abstract

Based on case studies of five Third World countries - Sri Lanka, the Philippines, China, Indonesia, and Suriname - Gillies explores the extent to which policy principles were applied in practice, showing that consistent, coordinated, and principled action is elusive even for countries with a reputation for internationalism. He highlights the growing rift between North Atlantic democracies and emerging Asian economic powers, the effectiveness of using aid sanctions to defend human rights, and the vicissitudes of human rights programming in emerging democracies. On a theoretical level, Gillies examines the explanatory power of political realism and the scope for ethical conduct in a world of states. Linking policy assertiveness with perceived costs to other national interests, he constructs a framework for analysing policy actions and applies it to his various case studies, concluding that when it comes to human rights the gap between principle and practice is still far too wide.

Abstract

A just international order and a healthy cosmopolitan discipline of law need to include perspectives that take account of the standpoints, interests, concerns and beliefs of non-Western people and traditions. The dominant scholarly and activist discourses about human rights have developed largely without reference to these other viewpoints. Claims about universality sit uneasily with ignorance of other traditions and parochial or ethnocentric tendencies. The object of the book is to make accessible the ideas of four jurists who present distinct 'Southern' perspectives on human rights.

Abstract

This book addresses a specific aspect of international criminal law. It describes the legal position and conditions of persons detained under the jurisdiction of international criminal tribunals, particularly as regards their internal legal position, their rights and duties inside the remand facility. Central to the book is the understanding that the circumstances surrounding these persons’ detention are different from a domestic context. The author’s primary aim is to disclose the law of detention of international criminal tribunals. The book sets out the applicable law, including the law’s underlying principles, and focuses on a number of specific procedural and substantive legal issues. As to procedural issues, it examines the available disciplinary and complaints procedures as well as procedures applicable to the designation of States for the enforcement of the tribunals’ sentences. In respect of substantive law, it focuses on the detainees’ right to contact with the outside world, including contact with their relatives, with their lawyers and with the media. The book further examines whether the positive law corresponds to the relevant international penal standards and human rights law. As an outcome of immediate exchanges (interviews) between the author and the authorities involved, the author provides a substantial clarification and critical assessment of the current issues and paradoxes of the domain in question. The book will be an extremely useful guidance for practitioners in applying the law and principles of the tribunals’ detention law, particularly because it is the first monograph written on the topic.  .
