‘How should we deal with religious pluralism in contemporary Europe from a human rights perspective and where should we draw the line, if any?’ This was the central question of an expert seminar held in 2006 at Utrecht University to celebrate the inaugural address of Abdullahi An-Na’im, who occupied the G.J. Wiarda Chair at the Netherlands Institute of Human Rights (SIM) in 2005/2006. His address, as well as the contributions to the seminar, is published in this volume. Though religious pluralism in itself is anything but new in Europe, the influx of large groups of non-Christians, especially Muslims, and the political climate after recent terrorist attacks have profoundly changed the terms of the debate on how to deal with it. Should all religions be treated the same, or is it legitimate to take European Christian heritage into account? Does religion deserve more protection than culture? What does it mean if we say the State has to be secular and/or neutral? How should freedom of religion be dealt with if it conflicts with other fundamental rights such as sex equality? And how should one approach limitations on the freedom of expression that are related to religion, such as hate speech bans or criminalisation of glorifying terrorism? The questions are set against the background of modern notions of citizenship and the European human rights framework. Though they do not lend themselves to easy answers, this collection endeavours to provide ample inspiration to take the discussion a step further.

Over the past twenty years, National Human Rights Institutions (NHRIs) have moved from the periphery to the centre of the human rights debate. The potential of NHRIs to transmit and implement international norms at the domestic level, and to transfer human rights expertise to regional and global human rights fora, is increasingly recognised. In Europe, the continent with the widest variety and density of human rights protection mechanisms, NHRIs are also gradually gaining recognition as actors that can enable more comprehensive and effective human rights promotion and protection. This book, the result of a COST conference held in Leuven in April 2012, focuses on the functioning and role of NHRIs in Europe in a comparative, European and international perspective. At a time when the European Union is looking for a more coherent and strategic human rights policy, it is important that policy makers and academics pay more attention to the potential role of NHRIs. By bringing together contributions from academics and practitioners, this volume offers insights into the opportunities and challenges that accompany the increasing emergence of NHRIs in Europe and their proliferation on the multiple levels of human rights promotion and protection. Accordingly, this volume aims to inform and further trigger the NHRI debate in Europe.

Garanti par l'article 8 de la Convention européenne des droits de l'homme, le " droit au respect de la vie privée " a été singulièrement développé par la jurisprudence de la Cour européenne des droits de l'homme. Mais la signification et la portée de ce droit restent, pour une large part, indéterminées tant sa diversité -du droit au secret au droit de vivre dans un environnement sain, en passant par la liberté de la vie sexuelle, la " vie privée sociale " ou le droit à l'autonomie personnelle- paraît défier toute tentative de systématisation. Préciser le sens du " droit au respect de la vie privée " -et d'abord de la notion même de " vie privée "-, prendre la mesure des conditions d'exercice de ce droit, apprécier la pertinence de la jurisprudence européenne dans une perspective comparatiste, tel est l'objet du colloque organisé par l'IDEDH, en novembre 2004, à la Faculté de droit de Montpellier, avec la collaboration de spécialistes éminents.
